[00:00:15]
BEFORE WE BEGIN, I'D LIKE TO JUST TAKE A MOMENT, A MOMENT OF SILENCE IN MEMORY OF MRS. NETTY, JOSEPH MOTHER-IN-LAW OF OUR MAYOR.
AND, UH, SO HE'S NOT GONNA BE WITH US TONIGHT.
AND I KNOW DAVID BUDDY HERE IS, IS WISHING HIM WELL, AND OUR THOUGHTS AND PRAYERS ARE WITH THE WHOLE FAMILY.
SO IF YOU WOULD JUST TAKE A MOMENT WE'D LIKE TO OPEN OUR MEETING WITH A PRAYER BY REVEREND LEE, RAY GREEN, TEMPLE BAPTIST CHURCH, REVEREND GREEN.
I PROBABLY WANT TO THANK YOU FOR A BEAUTIFUL, LOVING RELATIONSHIP THAT YOU HAVE THROUGH YOUR SON, JESUS CHRIST FATHER.
WE WANT TO THANK YOU FOR THE LIFE THAT YOU LIVE FROM DESERVE.
WE WANT TO THANK YOU FOR THE DEBT THAT HE GAVE FOR EACH ONE OF US, FOR THE FORGIVENESS OF OUR SAYINGS, PROBABLY DO ALL ACKNOWLEDGE TONIGHT OR THAT WE'RE ALL SINNERS IN NEED OF YOUR BREADS FOLLOWING BREAK OR THE POWER OF YOUR RESURRECTION TO CONTINUE TO DO WELL.
AND THEN OUR LINE AND FOLLOW WITH YOUR PEOPLE IN THIS LAND THROUGHOUT THE WORLD FATHER TONIGHT, I ALSO WANT TO GIVE THANKS FOR THE BOARD OF ALL YOU'VE EVER KNOWN, CAROLINE, WHO WAS STILL BEING ABLE TO HAVE AND TO DISEASE, THE WISDOM AND THE SPREADING OF CALLING, AND YOU REMAIN IN THIS PUBLIC PLACE.
FATHER, WE THANK YOU FOR THAT BOTTLE TONIGHT.
WE PRAY FOR YOUR WISDOM AND WE PRAY YOUR POWER AND WE PRAY FOR YOUR PEACE IN THIS MEETING.
WE PRAY FOR THE DIRECTION OR WHAT WE KNOW WHERE WE ARE IN GUYS.
WHAT WOULD THEY REPEAT? WE'LL BOP.
AND WE THANK YOU FOR THAT FOLLOW THE NIGHT.
AND WE ALSO PRAY THAT YOU WOULD BE WITH THE MAYOR AND HIS FAMILY AND THE LOSS OF HIS LOVED ONE LORD ONLY.
YOU CAN GIVE COMFORT TO WHERE THERE IS AN ABUNDANCE OF LOVE AND NEVER BEING BILLED BY ANYONE ELSE OR ANYTHING ELSE.
THE LORD BY THE, YOU CAN SPEAK TO THE HEARTS AND BRING ABOUT FEES AND RANTS AND WE MADE INTO TODAY.
SO TONIGHT PROBABLY JUST REJOICE THAT YOU ARE WITH US.
AND WE THANK YOU FOR THESE PEOPLE GATHERED HERE TONIGHT AND PRAY THROUGH EVERYTHING THAT'S SAID AND DONE.
IT WILL BRING GLORY AND HONOR TO YOUR NAME WHEN WE MAKE THIS PRAYER IN JESUS' NAME.
BEFORE WE MOVE INTO NUMBER THREE, I'D LIKE TO, UH, RECOGNIZE SOMEBODY.
UH, WELL, I, UH, IT'S A PRIVILEGE AS IT ALWAYS IS MADE TO BE HERE TONIGHT.
AND, UH, UNFORTUNATELY IT'S GOING TO BE MY LAST NIGHT.
UH, SO IF YOU DON'T MIND, UH, I WAS GOING TO READ THIS TO TOM, TOM ISN'T HERE.
SO I'LL READ IT TO RICK, UH, IS, WAS A SAD HEART THAT I'M TENDERING TO YOU.
MY RESIGNATION FROM THE NEWBURN BOARD OF ALDERMAN ALDERMAN EFFECTIVE AS OF MIDNIGHT, FEBRUARY 28TH, 1997.
IT'S NO SECRET I'M RESIGNING BECAUSE OF MY EMPLOYMENT SITUATION.
I HAVE SORTED THE PEOPLE, THE FOURTH WARD FOR THE PAST 13 YEARS HAVE ALWAYS TRIED TO PUT THEIR CONCERNS AND WISHES ABOVE ALL OTHER CONSIDERATIONS.
IT'S MY BELIEF THAT THE BOARD WILL CONSIDER THE SAME OBJECTIVE IN APPOINTING MY REPLACEMENT AND TALKING TO VARIOUS PEOPLE IN MY WARD.
I BELIEVE I FOUND JUST SUCH A PERSON.
HE WAS EYES AT 10 HIGH TREE LANE EAST.
I'VE BEEN WORKING WITH MR. MATTINGLY AND TRYING TO EASE THE DEVELOPMENT INTO VILLAGE WOODS.
AND HE SEEMS TO POSSESS BOTH THE GRIT TO FACE THE TOUGH FACTS AND DETERMINATION TO DO THE RIGHT THING IS NOT HAVING AN AX TO GRIND WITH THE CITY.
AND HE SEEMS TO HAVE A LOT OF COMMON SENSE IN A SENSE OF HUMOR.
UH, AND WE ALL KNOW IT WAS IMPORTANT.
AND THIS JOB, UH, IN CLOSING, I DON'T GUESS EITHER OF US HAD THE TIME FOR ME TO EXPOUND ON WHAT BEING AN ALDERMAN FOR THE CITY OF NEWMAN'S MEANT TO ME.
I'LL NEVER FORGET THE PEOPLE I'VE SERVED AND ALL THE PEOPLE THAT WORKED WITH ME, I'VE BEEN AFFORDED THE PRIVILEGE TO LEFT MY MARK
[00:05:01]
ON THE CITY.AND HOPEFULLY I'VE CONTRIBUTED TO THE POSITIVE DURATION THAT NEWMAN IS CURRENTLY FOLLOWING.
I WANT TO GIVE A SPECIAL THANKS TO SUE HARDISON, VICKI JOHNSON, RONICA MANNIX, NET WEST, AND ESPECIALLY MY WONDERFUL WIFE, LISA, NOT FOR THESE SPECIAL LADIES.
I WOULD HAVE BEEN IN A LOT MORE TROUBLE THAN I'M BEING.
AND LASTLY, I WANT TO THANK EACH MEMBER OF THE BOARD, BOTH PRESENT AND PAST THE CITY MANAGER AND THE CITY STAFF FOR THE COMRADERY THAT WE SHARED, BOTH POSITIVE AND NEGATIVE, AND I'LL NEVER FORGET ANY OF THEM.
YOUR RHYTHM NATION WAS EFFECTIVE FEBRUARY 28, THAT MADE YOU STILL HAVE TO WORK TONIGHT.
YOU CAN SIT DOWN
I WOULD LIKE TO REQUEST THAT ITEM.
NUMBER THREE, BE DELAYED UNTIL OUR NEXT MEETING.
THE FIRST MEETING IN THE MONTH OF MARCH DUE TO THE INABILITY OF THE MAYOR TO BE PRESENT.
AND HE HASN'T EXPRESSED AN INTEREST IN THIS ITEM AND I FEEL THAT IT WOULD BE PROPER FOR HIM TO BE HERE WHEN IT IS DISCUSSED AND ACTION TAKEN WELL, WE CAN'T PUT THEM ON TONIGHT ANYWAY, BECAUSE YOU CAN'T VOTE FOR, EXCUSE ME, YOU CAN'T VOTE FOR REPLACEMENT FOR DON A CONDITIONED UPON HIS RESIGNATION.
HIS RESIGNATION DOESN'T TAKE EFFECT UNTIL THE 28TH, SO WE COULDN'T VOTE TONIGHT ANYWAYS.
VOICE, BUT ALL IN FAVOR OF POSTPONING TILL THE NEXT MEETING, THE NEXT MEETING, ANYBODY OPPOSED? SORRY, FOLKS.
WE JUST HAVE TO STAY WITHIN THE FRAMEWORK OF THE LAW.
MR. EVENING, NEUBERGER WASTEWATER TREATMENT PLANT TREATED 1.2 MILLION GALLONS OF WASTEWATER DURING THE MONTH OF JANUARY WITH AN AVERAGE DAILY FLOW OF 3.3 MILLION GALLONS A DAY.
THE EFFICIENCY REMOVAL FOR REMOVING SUSPENDED SOLID WAS 80.5%, WHICH IS A VIOLATION OF THE NPDS PERMIT.
THE BOD EFFICIENCY REMOVAL WAS 84.5%, UM, WHICH IS CONSIDERED A PASSING MARK.
WE ALSO HAD TWO OTHER VIOLATIONS.
ONE WAS A WEEKLY VIOLATION THE LAST WEEK OF JANUARY, UH, WHERE WE EXCEEDED OUR 45 WEEKLY LIMIT WITH A 46.5.
WE ALSO VIOLATED OUR MONTHLY LIMIT OF 30 WITH A 38, UM, MILLIGRAMS PER LITER OF VOD BEING DISCHARGED TO THE RIVER.
WE HAVE DETERMINED, THERE ARE TWO MAJOR FLAWS IN THE PLANT DESIGN THAT WE HAVE ISOLATED.
UH, I'VE SPOKEN WITH, UM, DEPARTMENT OF WATER QUALITY, WHICH HANDLES OUR MPDS PERMIT TODAY.
UH, THEY HAVE, THEY AGREE WITH OUR, UM, ANALYSIS OF THE PROBLEMS AND AGREE THAT OUR STEPS OF ACTION SHOULD REMEDY THOSE PROBLEMS. UH, THEY HAVE TOLD US THAT THEY WILL ISSUE AUTOMATIC COMPUTER GENERATED NOTICES OF VIOLATION, BUT THEY DO NOT ANTICIPATE, UH, DOING ANY ENFORCEMENT ACTIONS, WHICH WOULD INCLUDE FINES OR, UH, ANY OTHER ACTION THAT, THAT, THAT MAY BE DEEMABLE.
UH, AND, UH, THAT WAS AN ACTION THAT I, THAT I'VE TAKEN TODAY.
WE WILL BEGIN THE PROCESS OF MAKING THE PLANT CHANGES IMMEDIATELY AND, UH, OPEN THE FLOOR AND ASK IF YOU HAVE ANY QUESTIONS.
WELL, I MEAN, THE IT'S A, IT'S A SERIOUS THING TO HAVE A VIOLATION, BUT I THINK WE'VE DETERMINED.
IT'S A DESIGN FLAW IN THE PLAN.
WE'VE HAD THESE SAME PROBLEMS FOR THREE YEARS RUNNING THIS SAME TIME OF YEAR.
WE HAD SOME, A TRICKLING FILTER SPECIALISTS FROM MALCOLM PIRNIE UP IN, UH, VIRGINIA COME IN LAST WEEK AND LOOK AT THE SITUATION WITH OUR STAFF.
THEY CONCURRED WITH THE STAFF'S FINDING, AND IT'S GOING TO COST ABOUT $20,000 TO TAKE CARE OF THE DESIGN FLAW STATE WILL HAVE TO APPROVE IT, BUT THEY'VE INDICATED THAT THEY WILL APPROVE IT WITHOUT ANY PROBLEM AND WILL BE TAKEN CARE OF THAT DESIGN PROBLEM WITHIN THE NEXT
[00:10:01]
60 TO 90 DAYS.SO I THINK THAT IT'S A REGRETTABLE, BUT IT'S SOMETHING THAT WE'RE ALL ON TOP OF.
AND WE'RE IN THE PROCESS OF DOING AWAY WITH, SO WE WON'T HAVE THIS PROBLEM AGAIN.
NEXT YEAR, THIS TIME THE LIGHT WE'VE EXPERIENCED THE LAST THREE YEARS, HOW LONG DID IT TAKE YOU TO GET THE DESIGN CHANGES MADE? UH, TODAY? UH, I'VE ALREADY SPOKEN WITH THE, UH, PLANNING REVIEW BRANCH IN RALEIGH.
I SPOKE WITH THE CHIEF AND HE SAID THAT WE MAY BE ABLE TO HANDLE THE DESIGN CHANGE JUST THROUGH A, A LETTER IN AND GO AHEAD AND GET IT APPROVED.
UH, WE HAVE A CONTRACT PENDING RIGHT NOW, UH, WITH A CONTRACTOR WHO'S GOING TO BE INSTALLING SOME PIPE FOR US.
WE COULD DO A QUICK CHANGE ORDER, UH, TO THAT CONTRACT.
AND I COULD HAVE THE PIPE IN, IN AS LITTLE AS SIX TO EIGHT WEEKS.
ONE OF THE, ONE OF THE THINGS I I'M SURE A LOT OF PEOPLE UNDERSTAND, BUT WHEN YOU'RE DEALING WITH SOMETHING, THE SCOPE AND THE MAGNITUDE OF A WASTE TREATMENT PLANT, IT'S NEVER THE SAME EVERY DAY.
YOU HAVE DIFFERENT FLOWS, WE HAVE DIFFERENT ALL KINDS OF DIFFERENT VARIABLES THAT YOU HAVE TO DEAL WITH.
DAVE, IF YOU HAD A STEADY FLOW OF THE SAME OF FLUID THROUGH IT EVERY DAY, BE EASY TO OPERATE, BUT THERE ARE A LOT OF CHANGES IN SOME OF YOUR CHANGES.
IT TAKES A WHILE BEFORE YOU EVEN CATCH IT.
SO I UNDERSTAND, AND I DO APPRECIATE THE WORK THAT YOUR GROUPS DO.
IT'S A PRETTY WELL THANKLESS JOB.
I DON'T THINK I'D LIKE TO WORK OUT, BUT WE DO APPRECIATE THEIR WORK AND FINDING WHAT THAT PROBLEM WAS JUST TAKEN.
LIKE YOU SAID, THREE YEARS TO FIND I'LL PASS THAT INFORMATION ALONG TO YOUR STAFF, AND THERE'LL BE APPRECIATED THAT VERY, VERY PLEASED WITH THE RESPONSE TO THE TEAM OUT THERE.
ANY OTHER QUESTIONS? THANK YOU.
I'M GOING TO, I MUST HAVE A GUARDIAN ANGEL OR SOMETHING.
I'M GOING TO HAVE TO SAY PUBLIC HEARING TO REZONE A 6.9 OR 6.29 ACRE TRACK PROFIT.
I LOVE KIDS ON THE SOUTH SIDE OF THE CURRENT ROAD AT THE INTERSECTION OF HIGHWAY 17, SOUTH FROM OUR 15 TO C3 OUR STAFF.
WOULD YOU LIKE TO BEGIN THIS? I'LL GO AHEAD AND GIVE YOU JUST AN INTRODUCTION.
UH, THE PROPERTY IS LOCATED ON THE SOUTH SIDE OF 17, BETWEEN THE OFFICES OF TESSIE, WHICH IS THAT YELLOWISH FRAME HOUSE, UH, RIGHT DOWN FROM THE HONDA VOLVO DEALERSHIP BETWEEN TENNESSEE AND THE COLONY TIRE PROPERTY.
THIS HAS BEEN REVIEWED BY THE PLANNING BOARD CONCERNS WERE EXPRESSED ABOUT IMPACT ON THE ADJACENT RESIDENTIAL AREA AND ALSO TRAFFIC ALONG 17 HELL THAT WOULD BE AFFECTED.
THE PROPERTY IS LOCATED NEAR THE BEGINNING OF THE EXIT RAMP OFF OF 17 ON TO TRENT ROAD.
UM, BASED ON DISCUSSION THAT TOOK PLACE AT THEIR MEETING, THE PLANNING ZONING BOARD RECOMMENDED THAT THE REZONING NOT BE GRANTED, BUT IN ITS ENDING COMMENT STATED THAT BASED ON THE LAND USE PLAN AND USES IN THE AREA THAT IT APPEARED COMMERCIAL WAS SOMEWHAT INEVITABLE TO TAKE PLACE IN THE AREA AND, UM, ENCOURAGE THE RESIDENTS AND THE PROPERTY OWNER TO DISCUSS AND TALK ABOUT THE ISSUE, WHICH AS I UNDERSTAND, THERE HAVE BEEN SOME DISCUSSIONS SINCE THE PLANNING AND ZONING BOARD MEETING.
AND IF YOU'D LIKE TO HAVE PUBLIC COMMENT, THEN, UH, BERNARD MYSELF CAN, UH, GIVE FINAL STAFF RECOMMENDATIONS AND COMMENTS FOLLOWING UP HERE.
UH, IS ANYBODY IN HERE IN THE ROOM IN FAVOR OF THE ZONING CLASSIFICATION? WOULD YOU LIKE TO SPEAK OKAY.
MY NAME IS JAMES HOFFMAN AND I REPRESENT THE LANDOWNER.
I'M THE ONE WHO PETITIONED FOR THE ZONING CHANGE.
UM, WE HAVE SPOKEN TO ONE MORE SALES LANDOWNERS WHO OPPOSED THE CHANGE IN THE OWNER HAS OFFERED THEM A 100 FOOT BUFFER STRIP TO BE PUT INTO A PERMANENT CONSERVATION EASEMENT.
AND, UM, IN OUR DISCUSSIONS, THEY SEEM TO BE ACCEPTED TO THAT.
I'LL LET THEM SPEAK FOR THEMSELVES.
BUT ONE OF THE PROBLEMS WE NEED TO TALK ABOUT IS HOW EXACTLY HOW THAT WOULD TAKE PLACE.
UM, I'VE TALKED WITH AN ATTORNEY AND I TALKED WITH MR. AVERY BRIEFLY TODAY AND MR. BERNARD, GEORGE HAS BEEN OUT OF TOWN, BUT, UM, WE GOT KIND OF A CHICKEN OR AN EGG SITUATION WHERE IF WE GO SPEND THE MONEY
[00:15:01]
TO GET THE, TO GET IT SURVEYED OUT AND DRAWN UP AND RECORDED AND ALL, AND THEN WE DON'T GET THE ZONING.WE DON'T KNOW WHAT TO DO FIRST.
AND WHAT WE GOING TO RECOMMEND THAT WE WERE GOING TO ASK YOU TO RECOMMEND US THAT MAYBE WITHIN THE NEXT COUPLE OF WEEKS, WE COULD WORK THAT OUT AMONG OURSELVES AND THEN COME TO THE MARCH 11TH MEETING AND TRY TO GET A FINAL SAY.
SO, UM, WE'RE SORT OF OPEN TO SUGGESTIONS.
UM, THE ATTORNEY SAID THAT THERE COULD BE A CONSERVATION EASEMENT PUT ON THE LAND THAT WOULD BE RECORDED THAT WOULD RUN FOREVER WITH THE LAND AND COULD NOT BE BROKEN.
UM, IT WOULD BE A QUESTION AS TO WHO WOULD BE THE BENEFICIARY WHERE IT WOULD BE THE ADJOINING LAND OWNERS OR EVERYBODY IN CYPRUS SHORES OR EVERYBODY IN THE COUNTY, YOU KNOW, WHERE DO YOU, HOW DO YOU MAKE IT ISN'T NECESSARILY A THING WE NEED TO WORK OUT.
I ALSO UNDERSTAND FROM TALKING TO MR. GEORGE, THAT THIS BOARD CANNOT MAKE A DECISION OR BASED UPON, UH, IF THEN TYPE OF SCENARIO ON THAT.
AND THAT'S WHY WE WOULD LIKE TO MAYBE HAVE THE NEXT COUPLE OF WEEKS TO TRY TO GET THAT WORKED OUT AMONG OURSELVES AND COME BACK TO YOU WITH A DEFINITE PLAN.
IT'S ALL YOU ASKING THAT WE NOT ACT ON THIS PROPOSAL TONIGHT? WELL, I WAS MY UNDERSTANDING.
YOU REALLY CAN'T BECAUSE IF THE LANDOWNERS SAY, YES, WE'LL TAKE THE A HUNDRED FOOT BUFFER AND WE SAY, WELL, WE'LL GIVE YOU THE A HUNDRED FOOT BUFFER.
IF WE GET C3 ZONING TO THE DEPTH OF THE TRACK, LESS THAN A HUNDRED, DO YOU KNOW THAT? IT'S MY UNDERSTANDING THAT THE BOARD CAN'T REZONE IT WITH THAT SORT OF CONTINGENCY ON IT.
THE AMOUNT OF THAT WE WOULD BE ABLE TO ACT ON THE NIGHT IS THAT, THAT YOU PRESENTED TO THE PLANNING BOARD.
SO I'M WONDERING NOW, IF YOU DID RENEGOTIATE IT AND COME UP WITH ANOTHER PLAN, BUT YOU NEED THEM TO GO BACK TO THE PLANNING BOARD.
COULD YOU, WOULD YOU NEED JUST TO COME TO US? I KNOW.
WELL, I WAS JUST HOPING IT COULD BE TABLE TO THE NEXT MEETING.
I DON'T, I WAS HOPING IT COULD BE TABLED UNTIL THE NEXT MEETING.
I DON'T KNOW HOW THE PROCEDURE WORKS THOUGH.
OKAY, MR. GEORGE, WOULD THEY HAVE, WOULD HE HAVE TO GO? WHAT WE'RE HAVING TO DEAL WITH NOW IS THAT, THAT YOU PRESENTED TO THE PLANNING BOARD THAT WAS DENIED BY THE PLANNING BOARD FOR US TO EITHER RATIFY OR TO REJECT WHAT I'M WONDERING IF THEY ARE TO RENEGOTIATE AND THEY'LL HAVE ANOTHER PLAN TO SUBMIT, WOULD, WOULD HE BE ABLE TO JUST COME TO US THE NEW PLAN OTHER THAN THE ONE THAT HE ALREADY SUBMITTED TO THE PLANNING BOARD OR WOULD IT NEED TO GO BACK THROUGH THE PLANNING? OKAY.
SO WE CAN JUST TABLE IT TONIGHT AND THEN MAKE OUR DECISION IN A COUPLE OF WEEKS.
THAT'S WHAT, UH, ONE THING I WAS HOPING THAT THE ADJOINING HOMEOWNERS COULD GET UP HERE AND SAY WHETHER OR NOT THEY WERE IN AGREEMENT, AND IF WE CAN GET THE LEGAL PART OF IT WORKED OUT, YOU KNOW, THEN WE COULD GO FORWARD IN THE NEXT WEEKS AND TRY TO GET ALL THE PROPER DOCUMENTATION AND ALL THAT.
I HAVE A COUPLE OF SHORT QUESTIONS.
UH, FIRST OF ALL, IS, IS KIND OF A TECHNICAL QUESTION WITH THE CITY ATTORNEY.
IF, UH, WELL, I'LL ASK THE OTHER ONE FIRST.
TELL ME WHAT YOU VISUALIZE IT.
CONSERVATION CONSERVATION EASEMENT OF BEING TH THE ONES THAT I'VE READ THE, UM, THE, YOU CAN'T GO OUT THERE AND CUT THE TIMBER AND MOW IT DOWN AND YOU CAN'T BUILD ANY STRUCTURES ON IT.
IS THERE TIMBER THERE NOW THERE'S SOME YOUNG CEDARS AND TIME THAT HAVE COME UP IN THE LAST 13 YEARS, IT WAS A FIELD 13 YEARS AGO WHEN THE CURRENT OWNER TOOK TITLE TO IT, AND MOST OF THEM ARE SMALL AND THEY'RE, SOME OF THEM ARE MAYBE AS HIGH AS THAT LIGHT, BUT MOST OF THEM ARE EIGHT OR 10 FEET TALL.
UM, WITH THE, WITH THE PROPERTY OWNERS CONSIDER PUTTING SOME TREES IN THERE TO HELP SCREEN COMMERCIAL FROM RESIDENTIAL ON WHY CAN'T SPEAK.
WELL, I'M JUST CURIOUS IF YOU HEARD THE MIDGET, IF THEY, IF THEY HAVEN'T MENTIONED IT, THAT'S ALL THE A HUNDRED FOOT WOULD BE PRETTY SOLID RIGHT NOW.
AND IT WOULD JUST CONTINUE TO GROW.
IT'S THIS PRETTY SOLID RIGHT NOW.
AND THE OTHER ONE WAS, UH, JUST A POINT OF ORDER, UH, FROM A LEGAL STANDPOINT, UH, MR. CITY ATTORNEY, IF, BECAUSE WE ADVERTISED A PUBLIC HEARING, WE SHOULD CONTINUE WITH THE PUBLIC HEARING AND THEN POSTPONEMENT.
I, I JUST, I WASN'T SURE ABOUT THAT.
BECAUSE FIRST OF ALL, WE'VE GOT SOME CITIZENS BACK THERE THAT CAME UP HERE TONIGHT AND WE WANT THEM REPRESENTED BECAUSE THIS INVOLVES YOU GUYS BACK THERE.
UH, THE GROUP IS OPPOSED TO THE REZONING.
DO YOU HAVE ONE PERSON THAT WOULD LIKE TO COME UP AND BE A SPOKESMAN ON WHAT WE'VE HEARD TONIGHT? THAT'S THE FIRST TIME I'VE EVER SEEN RICHARD SPEECHLESS? UH, GOOD EVENING.
I LIVE AT 38 0 9 MITCHELL CIRCLE, UH, DIRECTLY BEHIND THE PROPOSED SITE A FEW WEEKS AGO IN FRONT OF THE BOARD.
UH, THE ZONING BOARD, THE PLANNING BOARD,
[00:20:01]
UH, WE SPOKE AND ADDRESSED THIS PARTICULAR SITUATION AND CONFRONTED IT FOR THE FIRST TIME WITH A SMALL GROUP OF PEOPLE.I'D LIKE YOU TO FIRST UNDERSTAND THAT, UM, WE HAD EVERY INTENTION OF HAVING THE ENTIRE NEIGHBORHOOD HERE TONIGHT WHO WERE ALL VERY WILLING TO GO.
BUT AT VERY SHORT NOTICE, WE STARTED TALKING ABOUT THIS NEGOTIATION OF A A HUNDRED FOOT BUFFER ZONE THAT COULD BE MANDATED AS A CONSERVATION AREA.
THINGS THAT WE DON'T KNOW A WHOLE LOT ABOUT, WHICH KIND OF NIXED OUR PLANS TO BRING THE CROWDS.
UH, YOU SHOULD ALSO UNDERSTAND WITHOUT ANY DOUBT THAT MYSELF, AS WELL AS THE FOUR OTHER GENTLEMEN, FIVE OTHER GENTLEMEN, THAT ARE THERE ARE HIGHLY OPPOSED TO, UM, THE ZONING PERIOD.
UM, WHAT WE HAD DISCUSSED WAS AN INEVITABLE PROBLEM OF BEING A BUSINESS OWNER ON HIGHWAY 17.
I SEE THE SAME KIND OF THINGS, UH, OF THE COMMERCIALIZATION OF THAT PARTICULAR PIECE OF PROPERTY AS INEVITABLE, IF THAT PIECE OF PROPERTY IS GOING TO BE, OR IT LOOKS LIKE IN THE FUTURE, SOMETIME IT MIGHT HAPPEN.
ONE OF THE THINGS WE'RE CONCERNED ABOUT WAS, UH, MAINTAINING SOME TYPE OF BUFFER ZONE TO COVER OURSELVES, UH, AND OUR FUTURE NEIGHBORS.
SO WHAT WE'RE DISCUSSING WITH JAMES WAS TO DO EXACTLY, AND HOPEFULLY I SPEAK FOR THE GROUP TO, UH, TO TABLE THIS DECISION.
UM, IF WE CAN, IF WE CAN WORK OUT THE LEGALITIES BETWEEN NOW AND THE NEXT MEETING ON THE 11TH, UH, WE WOULD GREATLY APPRECIATE IT.
UM, ABOUT TWO MEETINGS, THIS, THIS ONE THING YOU DON'T RUSH, YOU SAYS YOU CAN ALL THE TIME YOU NEED.
YEAH, BECAUSE IT'S IMPORTANT TO ME.
IF YOU GUYS COME BACK AND SAY, YES, WE'RE SATISFIED WITH WHAT WE CAN ARGUE.
WE HAVE, WE UNDERSTAND WE, WE WILL AGREE WITH WHAT GOES ON BECAUSE WHATEVER HAPPENS IS FINAL.
I MEAN, DETACHED AND STONE, WE UNDERSTAND THAT, WHICH IS WHY WE WERE SO APPREHENSIVE ABOUT COMING UP SHORTHANDED TONIGHT.
WE HAD EVERY INTENTION AS WE PROPOSE TO THE ZONING BOARD TO OPPOSE THIS PARTICULAR ZONING AS BEST WE COULD.
AND WITH EVERY WAY WE COULD, UM, AGAIN, IT WAS KIND OF SHORT NOTICE.
UH, BUT WE ALSO DIDN'T WANT TO PUT JAMES IN A POSITION TO SAY, HEY, LOOK, YOU DIDN'T COME UP WITH ANYTHING IN TIME.
UH, WE NEED TO TALK ABOUT IT JUST BECAUSE WE CAME UP ON THIS DATE, DOESN'T SEEM RIGHT, THAT WE SHOULD HAVE TO MAKE A SNAP DECISION.
WE WILL NOT MAKE A SNAP DECISION TONIGHT.
THE FIRST MEETING IN APRIL TO TOO LATE, WAS THAT TOO MUCH TIME TO, UH, BRING THIS BACK UP? IS IT TOO SOON? THE FIRST MEETING IN APRIL, OUR FIRST, IMMEDIATELY OUR FIRST MEETING THAT WILL BE THE SECOND TUESDAY OF THE MONTH.
THAT TWO IS TOO LONG OF A TIMEFRAME WAS TOO SHORT TO WHAT? UH, NO, I, I THINK IF WE CAN, UM, GET OUR ATTORNEYS TOGETHER AND DECIDE WHETHER THIS CAN BE THE BIGGEST QUESTION WE HAD TONIGHT THAT WE WERE SPEAKING, YOU KNOW, WE WERE TALKING ABOUT IN THE HALLWAY, WAS LIKE JAMES SAID THE CHICKEN AND THE EGG.
WE DON'T WANT TO SAY, OKAY, ZONE AT OUR 15 HOUR ZONE AT COMMERCIAL.
IF, UM, IF AFTER YOU ZONE IT, WE'RE GOING TO HAVE TO SIGN TO SAY, WE HAVE A BUFFER ZONE.
WE WANT NO ONE TO MAKE A DECISION UNTIL EVERYTHING IS ON PAPER.
SO WE CAN, WE WEREN'T SURE IF THAT COULD BE DONE.
WE DIDN'T KNOW IF IT HAD TO BE ZONED COMMERCIAL.
AND THEN WE HAD TO CHANGE THE WAY THE BUYER WAS.
THE SELLER WAS SELLING IT, OR WE WEREN'T REALLY SURE JAMES HAS GOT AN ATTORNEY INVOLVED AND I'M SURE THEY'LL HELP US OUT.
AND WITH OUR ATTORNEYS, THAT PROBABLY WON'T BE A PROBLEM.
WOULD THERE BE A PROBLEM IF IT GOT TO APRIL TO DO THIS AGAIN? IF FOR SOME REASON WE DIDN'T, THERE'S NEVER BEEN A PROBLEM WITH THE CONCERN THAT THE CITY NEVER.
AND IF IT'S NOT, IF YOU'RE NOT READY IN APRIL, WHEN YOU'RE READY, WE'LL GO.
BEFORE YOU, YOUR STEPDAD, MR. WARD, HAVE YOU GOT ANY COMMENTS ON THIS? SO OBVIOUSLY NO REASON WHY IT CAN'T BE WORKED OUT.
IF WE WORK BETWEEN YOUR ATTORNEYS, CITY, ATTORNEY TO STAFF, I THINK WE CAN COME TO SOME SORT OF UNDERSTANDING.
AND I KNOW THAT MR. GEORGE WAS BE GLAD TO HEAD UP THIS.
I THINK THIS, THIS MAY BE THE FIRST TIME IN A LONG TIME.
WE'VE HAD A WIN-WIN SITUATION.
YEAH, BUT I THINK WE CAN FINISH IF WE WOULD BE, IT MAY BE AN ASSET TO YOUR NEIGHBORHOOD TO HAVE THIS BUFFER.
WELL, EITHER WAY, OBVIOUSLY THE SITUATION HAS TO BE RECTIFIED.
IT'D BE NICE TO HAVE IT GO THROUGH
[00:25:01]
THE BOARD OF ALL THE MEN WHERE, BUT HE WAS HAPPY.AND THE OTHER QUESTIONS, THANK YOU, BUDDY.
ON THE BOARD, MAYOR PRO TEM A PILLS.
WE MAKE A MOTION THAT WE TAKE THIS PUBLIC HEARING UNTIL THIS FIRST MEETING IN APRIL.
WE HAVE A MOTION TO CONTINUE THIS PUBLIC HEARING A SECOND.
WE NEED TO SET THAT MEETING APRIL 1ST, MEETING THE FIRST MEETING, AT LEAST THE FIRST MEETING IN APRIL.
AND WE NEED A VOICE FOR MS. MA'AM.
ALL THOSE IN FAVOR OF TABLING, THE MEETING UNTIL THE FIRST MEETING IN APRIL BY TABLE.
IN THE FOLLOWING HEARING TO THE FIRST MEETING, APRIL SIGNIFY BY SAYING, AYE, ANYBODY OPPOSE THIS PUBLIC HEARING IS POSTPONED UNTIL THE, AT LEAST THE FIRST MEETING IN APRIL DO YOUR THING.
NEXT ITEM IS A CONSENT AGENDA.
WE ADOPTED THE SYNONYM SEC, MR. MAYOR PRO TEM ONE, ONE, UH, QUICK AUTUMN.
I WAS JUST NOTICING ALL THE DENTIST SAYS MARCH THE FOURTH, TO MOVE THAT MEETING DATE, IT SHOULD BE MARCH THE 18TH, NOT MARCH THE FOURTH.
THAT WAS AN ERROR THAT WAS AS A RED.
WE HAVE A MOTION TO SAY, WE NEED A ROLL CALL ON THIS DUTY THIS, HEY.
AND I'LL MAKE A COMMENT ABOUT ONE OF THESE ITEMS ON THE CONSENT AGENDA.
SHORT COMMENT, UH, ITEM NUMBER 11, ACTION.
JUST TAKE THEM, MAKES ME THE CITY'S APPOINTEE TO THE REGIONAL WASTEWATER TASKFORCE.
AND, UH, I WELCOME THE CHALLENGE AND IT IS GOING TO BE A CHALLENGE.
A LOT OF WORK HAS ALREADY BEEN DONE AND THE PUBLIC MUST REALIZE THAT THE FUTURE OF OUR ENTIRE LIFESTYLE HERE DEPENDS ON FINDING WAYS TO BETTER DISPOSE OF THE WASTEWATER GENERATED BY HUMAN BEINGS, MOVING TO THIS AREA AND ALREADY LIVING HERE SO THAT AS WE EXPAND IN TOTAL POPULATION, WE WILL NOT DESTROY THE LAND THAT WE HAVE COME TO LOVE SO MUCH.
UH, MANY SOLU, SEVERAL SOLUTIONS HAVE BEEN SUGGESTED.
UH, WE'VE GOT TO KEEP IN MIND THAT EVEN THOUGH WE HAVE VERY PURE DRINKING WATER NOW, WHICH COMES FROM VERY DEEP THAN THIS AND THE ROCK UNDERLYING OUR AREA OF THE BLACK CREEK AQUIFER, THE WATER THERE IS DROPPING FOUR TO FIVE FEET EACH YEAR.
AND PERIODICALLY WE HAVE TO SPEND A LOT OF MONEY TO LOWER OUR WELLHEADS, TO STILL BE ABLE TO GET ENOUGH WATER HERE, TO SUPPLY THE PEOPLE THAT IS, YOU MIGHT SAY PREHISTORIC WATER.
IT TOOK MILLIONS OF YEARS TO GET THERE.
AND IT IS LITERALLY NOT BEING REPLENISHED.
SO AT SOME POINT IN THE FUTURE, PERHAPS LONG AFTER I'M GONE, BUT AT SOME WAY, WE LIKE TO PLAN THAT THERE WILL BE A FUTURE.
THERE WILL BE OTHER PEOPLE WHO BENEFIT AND NOT SUFFER FROM THE ACTIONS WE TAKE.
AT SOME POINT IN THE FUTURE, WE WILL BE LOOKING FOR ANOTHER SOURCE OF DRINKING WATER AND IT MAY BE THE RIVER UNLESS SOMEBODY CAN DISCOVER ANOTHER SOURCE.
AND FOR THAT REASON, IT'S VERY IMPORTANT.
THE WAY WE HANDLE OUR RIVERS AND WE HAVE TO GET ALL OF THE, UH, SEWER PLANT EFFLUENT.
WE CAN OUT OF THAT RIVER OVER THE NEXT 10, 12 YEARS, HOWEVER LONG IT TAKES.
AND THAT IS ONE OF THE MAJOR TASKS ON THIS REGIONAL WASTEWATER TASKFORCE IS TRYING TO FIGURE OUT HOW TO DO SOMETHING NOW TO PREVENT A MONUMENTAL DISASTER.
AT SOME POINT DOWN THE ROAD, AS LONG AS WE CONTINUE TO RUN WATER THROUGH THE PIPES IN OUR HOUSE, THERE'S GOING TO BE A PROBLEM.
THE IDA, THE IDEA OF SEPTIC TANKS IN NORTH CAROLINA HAS MORE SEPTIC TANKS THAN ANY OTHER STATE IN THE UNION LAWS GOVERNING SEPTIC TANKS ARE VERY WEAK AND VERY POOR.
AND THERE ARE A LOT OF SEPTIC TANKS OUT THERE, WHICH AREN'T DOING THE JOB AND THERE'S GOING TO BE AT SOME POINT, AND IT'S NOT GOING TO BE TOO LONG WHERE REGULATIONS CHANGE DRASTICALLY IN THE WAY WE DEAL WITH SEPTIC TANKS.
ALTHOUGH IT IS A VIABLE OPTION, THERE'S GOING TO BE A MAJOR CHANGE COMING DOWN THE HIGHWAY FROM WA I'M FROM RALEIGH AND HOW THE SEPTIC TANK SITUATION IS HANDLED IN EASTERN NORTH CAROLINA.
SO THIS IS AN IMPORTANT GROUP.
AND, UH, I THANK YOU FOR HAVING CONFIDENCE IN ME TO APPOINT ME, TO REPRESENT THE CITY ON THIS BOARD.
I PROMISE YOU I WILL DO THE BEST I CAN BECAUSE IT IS VITAL TO THE FUTURE ON THE AREA THAT A SOLUTION TO OUR WASTEWATER PROBLEMS BE FOUND.
TEXTILE APPOINTMENTS, MS. LEE, MR. FREE.
[00:30:01]
I DON'T HAVE MY PAPERWORK, BUT WE DON'T HAVE THAT HERE ANYMORE.I HAVE AN OPENING, A SPOT ON THE PLANNING BOARD, CORRECT.
AND I HAVE A GENTLEMAN MR. PETER MOFFITT, HE AND HIS WIFE, LEUCINE HAS LIVED HERE.
THEY'RE GOOD PEOPLE HE'S BEEN HERE FOR 17 YEARS.
HE WAS THE ONE FROM OUR SCHOOL SYSTEM.
HE IS A MINING ENGINEER WITH EXTENSIVE EXPERIENCE IN ENVIRONMENTAL AFFAIRS.
I BELIEVE HE COULD BE AN ASSET FOR A PLANNING BOARD, REALLY GOOD RESOURCE GEORGE IN SOME OF THESE TIMES OF NEED.
AND THEY SEEM TO BE COMING MORE FREQUENTLY TIMES.
HE JUST SPENT SEVEN YEARS DEVELOPED ON AN ENVIRONMENTAL IMPACTS THAT GOT A LOT OF SPIRITS.
YOU GOT A SECOND, ALL THOSE IN FAVOR, ALL THOSE, I GUESS WE PASSED A MISCELLANEOUS MS. LEE.
I GUESS HE GOT INTO MY WAITING, BEEN INFORMED OF THE MEETING THAT THEY HAD WITH, UH, UM, UH, WEED AND SEED PROGRAM, KICKING IT OFF.
AND THIS IS, WHAT'S YOUR NAME AGAIN? MAN.
DANA WAS AT THE MEETING AND SHE AND CAPTAIN SMITH CONDUCTED.
AND WE'RE LOOKING FORWARD TO IMPLEMENTING THAT GRANT PROGRAM FOR THE WEEDING SEED PROJECT, FORMERLY KNOWN AS THE MCCARTER HOUSE IS WANTING TO KNOW THAT.
I THINK THERE'S GOING TO BE A GREAT PROGRAM.
I THINK FOR ME RIGHT NOW, YES.
I SEE WE HAVE TWO CANDIDATES PRESENT TONIGHT.
I THINK MR. MANLEY IS ON THE THIRD ROW.
MS. FRANCIS IS IN THE REAL BARBARA FRANCIS IN THE REAR.
I HAVE ONE, YOU MAY KNOW, DEVELOPMENT IS OCCURRING ON QUEEN STREET, A QUESTION
I'D LIKE SOME DIRECTION ON THE BOARD.
HOW THE BOARD WOULD LIKE TO GO FROM THE SOUTHERN RIGHT AWAY LINE OF QUEEN STREET OUT INTO WAYNE STREET BY 20 15, 20 FEET, 20 FEET.
UH, I'VE HAD A NUMBER OF CONVERSATION WITH DANNY ABOUT IT.
I'VE DONE SOME LOOKING AT MATERIAL.
HE PROVIDED ME FROM THE RECORDS TO THE DIRECTORS OF THE CITY.
AND IT DOESN'T APPEAR TO BE ANY QUESTION, BUT WHAT IS
MY RECOMMENDATION, THE RIGHT OF WAY.
SO THAT SAYS, UH, 20 FEET, 20 FEET WIDE EXTENDED AREA, WHICH IS NOT ALL DOWN TO THE LEVEL TO MAINTAIN ACCESS TO THE ROAD, AT LEAST 20.
AND THEN JUST GOING DOWN TO THE RIVER, WE WOULDN'T, WE WOULDN'T HAVE TOO MUCH OF A CHANGE TO EASE FRONT AND COMING INTO QUEEN.
AND THEN WE'LL BE
WE'LL WE'LL BE ABLE TO ACCOMMODATE
THEY WANTED TO MOVE OUT TO LIVE 20 FEET.
THIS IS THE OTHER SIDE OF THE QUEEN
[00:35:01]
STREET, 60 FEET, RIGHT ON DOWN.I'M NOT ASKING THE COURT TO TAKE ANY AFFIRMATIVE ACTION AT NIGHT.
OTHER SUGGESTIONS WOULD LIKE FOR ME TO RECEIVE AND NEGOTIATE PRICE.
IF WE, IF WE'VE GOT TO LOSE ON PROPERTY AND WE NEED SOME COMPENSATION, UH, WHY WOULD YOU WANT SOME COMPENSATION FOR SOME PROPERTY THAT YOU HAVE NEVER USED? AND IT'S JUST SITTING THERE.
I DON'T FIND YOU TO BE COMPENSATED FOR SOMETHING FOR THAT.
WELL, THE ONLY THING WE'RE DOING THERE IS MAKING SURE THAT WE STILL HAVE THE RIGHT TO THE RIVER.
THIS PROPERTY RIGHT HERE RIGHT NOW HAS NOTHING BUT DIRT.
THAT'S EAST FRONT GOING INTO QUEEN HERE.
WHO GIVES AWAY PROPERTY FOR FREE? WE WE'VE DONE.
WE CALLED THE RIGHT-WING STREETS.
THE FIRST TIME I'VE SEEN THIS, I DON'T KNOW WHAT TO DO.
I WAS DOWN THERE YESTERDAY AND LOOKED AT IT.
THEY'RE GOING TO HAVE A BEAUTIFUL DEVELOPMENT THERE AND I'D LIKE TO HELP THEM WHAT WE CAN.
YOU KNOW, THE CITY IS NOT IN THE BUSINESS OF GIVING AWAY CITY PROPERTY OR BLOCKING OFF THE RIVER ACCESS, ET CETERA.
BUT THERE IS ANOTHER FACET TO IT THAT HAS TO DO WITH MODIFICATION OF THE STREET, WHERE THAT BEND IS, WHICH WOULD IN WHICH THEY WOULD OCCUR AND CURSE AND CONSIDERABLE EXPENSE.
SO ACTUALLY WHAT IS BEING DONE IS THEY'RE LOOKING AT, WHO'S GOING TO DO WHAT, AND I THINK THE CITY IS GOING TO COME OUT VERY WELL ON IT.
I THINK THAT'S ANOTHER ONE OF THOSE WIN-WIN SITUATIONS WE'RE TALKING ABOUT, BUT I DON'T BELIEVE THAT, UH, THE CITY ATTORNEY OR DANNY OR ANYONE ELSE IS GOING TO LET THE CITY COME UP ON THE SHORT END, UH, DOLLAR WISE, I THINK IT'S GOING TO BE WORKED OUT TO AN AMICABLE SOLUTION.
AND I THINK THAT THAT DEVELOPMENT, WHEN IT IS FINISHED IS GOING TO BE A REAL BENEFIT TO THE AREA.
SO I THINK WE'RE ON THE RIGHT TRACK THERE.
AND THE NEGOTIATION IS CONTINUING THE BEST THING TO DO TO CONTINUE NEGOTIATIONS AND COMBAT WITH GOOD PROPOSAL WITH GOOD RECOMMENDATION.
AND TO WHAT EXTENT AS YOU REDUCE THAT RIGHT AWAY, YOU START CUTTING OUT OPTIONS FOR FUTURE PUBLIC ACCESS.
AT THAT POINT, I THINK SHOULD BE BROUGHT INTO CONSIDERATION AS THIS THING IS BEING PROPOSED.
I WOULD HOPE THAT YOUR GROUP WOULD BE INVOLVED IN IT, MAKING THE RECOMMENDATIONS NECESSARY TO PROTECT OUR INTERESTS.
SO WE HAVE A MOTION AND A SECOND TO ASK CALL FOR A PUBLIC HEARING.
I THINK THAT PROBABLY WOULD BE
I DID NOT PREPARE
SO IF THE INITIATE PROCEDURE FOR A PORTION OF THAT STREET AND AT THAT TIME, GOODBYE, SATISFIED WITH THAT.
BUT LISTEN, WHEN THEY COME BACK AND THEY BRING PHOTOGRAPHS SHOWING WHERE WE'RE GOING TO, WHERE IT IS, CAUSE I CAN GET A BETTER FEEL FOR VIDEO VIDEO.
THIS IS A DEVELOPMENT ADD TO THE TAXPAYER AND IF YOU DON'T KNOW WHAT'S GOING TO BE, AND IT WILL BE, IT'S GOING TO BE ON BOTH SIDES OF QUEEN STREET, BOTH SIDES.
