[00:00:05] OH, I LEFT THEM WITH A PRAYER. I AM THE GREGORY SAINT STEPHEN SPREEWELL BAPTIST CHURCH. OKAY. HE'S NOT HERE, DANNY FATHER. WE THANK YOU FOR THIS PRIVILEGE. WE HAVE TONIGHT TO COME TOGETHER AND DO THE BUSINESS OF THIS CITY. WE ASK LORD THAT YOU GIVE EACH ONE OF THE BOARD MEMBERS GUIDANCE OR GIVE THEM THE, UH, VISION TO SEE THAT WHICH IS BEST FOR OUR COMMUNITY. BLESS EACH ONE OF YOU THAT ARE HERE. GOD, LET EVERYTHING BE DONE DECENTLY IN ORDER, AND GOD WILL PRAISE YOU FOR THAT, WHICH HAS DONE. WHAT'S IN CHRIST'S NAME. WE PRAY FOR SAY YOU MAN. TO THE FLAG ONE NATION UNDER GOD. OKAY. FIRST THING WE HAVE TONIGHT IS OUR MONTHLY REQUEST AND PETITION FROM CITIZENS. DO WE HAVE ANYBODY HERE ON THAT CATEGORY TONIGHT THIS MORNING TO COME UP AND SPEAK ABOUT SOMETHING IN GENERAL, YOU DO JUST RAISE YOUR HAND IF THERE'S ANYBODY OUT THERE, NOBODY OUT THERE. OKAY. WE'LL PASS THAT AND GO ONTO THE NEXT THING, WHICH IS THE PRESENTATION OF THE LEADERSHIP BRAVEN CLASS OF 2000 PRODUCTS, WHICH IS AN EXCELLENT PRODUCT. DON'T DO THAT. THE LEAD OFF ON THAT. WILL THAT BE OKAY. COME ON UP. EATING MAYOR, BOARD BALDWIN. MY NAME IS DAVID KOHLER AND I'M A 2000 GRADUATE AND CLASS MEMBER OF LEADERSHIP CRAVING. I'M HERE REPRESENTING THE 2000 CLASS. AND I WOULD LIKE TO ACKNOWLEDGE ALL OF OUR CLASS MEMBERS ARE HERE IN ATTENDANCE. UH, ASK THEM TO STAND UP. WE HAVE MOST OF OUR CLASSES HERE IN ATTENDANCE. UM, AND THIS IS A GROUP PROJECT. UM, AS YOU NOTED FROM PROPOSAL, WE'RE ASKING FOR A WORKING PARTNERSHIP WITH THE CITY OF NEW BERN, UM, WITH THE GOAL OF IMPROVING THE PLAYGROUND EQUIPMENT AT THE HENDERSON PARK STANLEY WHITE CENTER. AND I BELIEVE MOST OF YOU ARE PROBABLY FAMILIAR WITH LEADERSHIP CRAVING. FOR THOSE OF YOU WHO ARE NOT, IT'S A PROGRAM THAT IS ORGANIZED BY THE NEWBURN AREA CHAMBER OF COMMERCE, BUT INVOLVES ORGANIZATION, UM, FROM MANY FACETS IN THE COMMUNITY, PRIVATE SECTOR, PUBLIC SECTOR, AND INDIVIDUALS. AND THROUGH THIS, WE HAVE A CLASS OF 25 INDIVIDUALS THAT HAD A UNIQUE OPPORTUNITY TO EXPERIENCE A SILVER AREAS WITHIN THE COUNTY. AND JUST WANT TO RECOGNIZE THAT THE CITY OF NEW BERN WAS AN EXCELLENT HOST FOR THIS PROGRAM. THEY ALLOWED US TO LEARN ABOUT, UH, UH, CITY AND COUNTY GOVERNMENT, UM, ALSO LEARNED ABOUT THE JUDICIAL SYSTEM, UM, POLICE DEPARTMENT. AND SO WE, I WANT TO THANK YOU FOR THAT, BUT, UM, AS YOU CAN SEE IN THE PROPOSAL, UH, WE HAVE A PLAN SET FOR, UH, INVOLVING THIS PARTNERSHIP AND WE'RE ASKING FOR THE CITY SUPPORT AND I'M GOING TO ASK, UH, GLEN MCCOY, ONE OF OUR CLASS MEMBERS TO COME FORWARD AND GIVE YOU SOME DETAILS ON THE PROJECT. AND THEN I'M GOING TO ASK BOB MINI WHO'S OUR, UH, FUNDRAISING CHAIRMAN TO DISCUSS OUR PLANS FOR RAISING FUNDS. AND THEN WE'LL BE OPEN TO ANY QUESTIONS THAT YOU MAY HAVE ABOUT THIS PROJECT. THANK YOU. AT THIS STAGE, WE'VE JUST GOT A, KIND OF A WORKING DOCUMENT. UH, WE'VE BEEN WORKING WITH, UH, JIMMY TOWER OF THE MIRACLE EQUIPMENT COMPANY. THIS IS A COMPANY, I THINK IT'S DONE SEVERAL PROJECTS IN THIS AREA AND WE KIND OF PRESENTED TO THEM BECAUSE AT THIS STAGE, WE'RE NOT SURE JUST WHAT OUR BUDGET'S GOING TO BE AND JUST WHAT, UH, UH, HOW WE'LL WORK OUT THE DETAILS. BUT WE'RE LOOKING AT IT AT ABOUT A $50,000 PROJECT WE'D LIKE TO DO MORE, JUST DEPENDS ON WHAT KIND OF FUNDRAISING WE CAN DO AND HOW MUCH SUPPORT WE GIVE FROM THE CITY. BUT WHAT WE'RE PROPOSING TO DO IS, UH, BUY THE EQUIPMENT. UH, AND AGAIN, THIS IS SOMETHING WE'RE GOING TO HAVE TO LEARN AS PART OF A CITY PROJECT THAT WE'RE GOING TO HAVE TO GO TO SOME TYPE OF BIDDING, OR CAN WE PICK THE EQUIPMENT AND, AND, YOU KNOW, THERE'S A LOT OF QUESTIONS. THERE'S PROBABLY MORE QUESTIONS THAN THERE ARE ANSWERS, RIGHT, IN THAT WE THINK WE'VE GOT TO GO, BUT WE NEED SOME GUIDANCE AND SOME HELP TO GET THAT. SO WHAT WE'RE TRYING TO DO TONIGHT IS [00:05:01] JUST MAKE YOU AWARE OF WHAT WE WOULD LIKE TO ACCOMPLISH AND ASK FOR SOME ASSISTANCE IN, HOW DO WE GO ABOUT DOING THIS? WE'VE BEEN TALKING WITH THURMAN AND HE'S GIVEN HIS COVENANT, UH, AN IDEA OF AN AREA THAT WE CAN USE AND SOME IDEA OF, OF, UH, HOW MUCH EQUIPMENT THAT WE MIGHT BE ABLE TO PUT IN THERE. AND THIS REPRESENTS ABOUT A $50,000 INVESTMENT IN EQUIPMENT AND INSTALLATION. UH, WE, AS A CLIENT ARE WILLING TO, TO PARTICIPATE BY, UH, OUR FREE LABOR, IF IT'S, IF IT'S NO MORE THAN, THAN PUTTING THE WOOD CHIPS OUT OR POSSIBLY HELPING WITH THE EQUIPMENT, WE'RE KNOW THERE'S SOME CONCERN ABOUT LIABILITY. THERE'S A LOT OF QUESTIONS THAT WE NEED SOME GUIDANCE AND SOME HELP ON. SO THIS IS WHAT WE HAVE IN MIND. AND WE THINK THIS WOULD BE A REAL, UH, BOOST TO THAT AREA THAT WE'VE BEEN OVER. WE VISITED THAT AREA AND WE SEE A LOT OF, OF ACTIVITY WITH KIDS AND ALL IT, THERE'S REALLY NOT THIS KIND OF EQUIPMENT THEY'RE AVAILABLE FOR THEM TO PLAY ON. SO AS A PRICE, THIS IS WHAT WE HAVE IN MIND. AND WE WOULD ASK YOUR SUPPORT ON ANY QUESTIONS ON THE EQUIPMENT PORTION OF IT. AND WE'LL BE GLAD TO LEAVE THIS WITH YOU, IF YOU WOULD LIKE TO HAVE IT TO, TO VIEW. AND AGAIN, IT'S A WORKING CONCEPT. AND YOU SAY THAT, UH, THAT YOU HAD WORKED WITH, UH, MR. HARVEST AND THURMOND ARTISTS. AND WE HAVE TALKED TO HIM ABOUT THIS. SHE ASKED WE HAD JACK, CAUSE I KNOW HE'S REAL FOR ME, BUT DO YOU KNOW PROBABLY WHAT TYPE OF EQUIPMENT YOU WOULD NEED AND THAT TYPE OF THING. AND I JUST THINK IT'S, THAT'S A WONDERFUL PRODUCT. OKAY. WE'LL LET BOB NITTY MAKE THIS LEAP THIS YEAR. SAY, YEAH, THAT WOULD BE FINE IF YOU, UH, YOU HAVE TO UNDERSTAND THAT MOST OF US, LIKE IN MY CASE, WHEN YOU GET ELECTED TO BE MAYOR, YOU DON'T HAVE ANY EXPERIENCE AND THERE'S NOT A HANDBOOK THAT SAYS HOW TO BE MAYOR. SO YOU ALL HAVE GOT SUCH A TREMENDOUS HEAD START ON ANY TYPE OF PUBLIC JOB YOU MAY WANT TO TAKE UP IN THE FUTURE OR WHATEVER ROOF. WE WANT TO GO DO THIS AND SAY, OKAY, WE'VE GOT THE MONEY. LET'S GO HIRE THIS GUY. THERE'S LOTS OF . WE NEED YOU GUYS. YEAH, WE CAN, WE CAN HELP YOU WITH ALL THAT. AND WE APPRECIATE IT. I'VE GOT A HANDBOOK ON FUNDRAISING. YOU START OUT LIKE WHY WE'RE HERE TONIGHT, MAYOR, GOOD EVENING. I'M BOB NANNY. AND UH, WE'RE LOOKING AT A SCALABLE PROJECT. WHAT GLEN SHOWED YOU WAS A $50,000 ORDER MAGNITUDE PROJECT. WE THINK WE CAN DO A VERY NICE ONE FOR 40,000. WE CAN DO A WONDERFUL ONE FOR 75,000. SO THOSE ARE THE KINDS OF PARAMETERS WE'RE LOOKING FOR. AND AS DAVID SAID, ONE OF THE FIRST THINGS WE'RE LOOKING FOR IS A COMMITMENT FROM THE CITY. HOPEFULLY FOR SOME $25,000 OUT OF YOUR NEXT FISCAL YEAR BUDGET, WE'VE BEEN A LITTLE HESITANT TO GO OUT AND LOOK FOR FUNDRAISING FROM OTHERS UNTIL WE GET A COMMITMENT FROM THE CITY THAT BEING SAID, I WILL TELL YOU THAT THE PEOPLE IN THIS ROOM REPRESENT A COMMITMENT OF $12,000 ALREADY. AND WE HAVEN'T EVEN STARTED, UH, IT WOULD BE OUR INTENT TO SOLICIT THE COMPANIES WHO SPONSORED US AND CRAVING LEADERSHIP CRAVING. IT WOULD BE OUR INTENT TO SOLICIT, UH, COMPANIES WHO ARE SPONSORS OF THE CHAMBER OF COMMERCE. WE'D ALSO LOOK AT A GENERAL MAILING. WE'D ALSO LOOK TO SOME OF THE MEMBERS OF LEADERSHIP CRAVE IN 2001 WHO ARE HERE TONIGHT. AND LASTLY, AND MAYBE MOST IMPORTANTLY, UH, WE'D LIKE TO THINK ABOUT HAVING A NAME, SPONSOR, SOMEONE WHO WOULD MATCH THE CITY'S FUNDS FOR EXAMPLE, AND WE COULD NAME IT THE, UH, THE PARK AFTER THAT PERSON. AGAIN, WE DON'T KNOW WHETHER THAT'S POSSIBILITY OR NOT, BUT, UH, THAT WAS STARTING TO BE A WAY TO RAISE SOME SIGNIFICANT FUNDS ALL AT ONCE. SO OUR GOAL WOULD BE 75, 25 FROM THE CITY 25 FROM THE NAME SPONSOR AND 25 FROM THE REST OF US. WE THINK WE'RE ASSURED OF GETTING 40 AND WE THINK WE CAN DO A FINE PROJECT IF THAT'S ALL WE'RE ABLE TO. DO YOU DO SWIMMING POOLS? MAYBE THAT'D BE OUR SECOND PRICE. I THINK IT'S ANY QUESTIONS FOR ANY OF OUR COMMITTEE? NO, NOT REALLY. I'M JUST TICKLED TO DEATH. UH, YOU KNOW, Y'ALL WERE TAKING IN FIRST OFF, IT TAKES A LOT OF INITIATIVE TO GET INVOLVED IN SOMETHING LIKE LEADERSHIP, CRIME AND EVERYTHING I'VE SEEN OF IT, UH, HAS BEEN JUST EXCELLENT. YOU KNOW, ALL THE PEOPLE THAT HAVE BEEN THROUGH IT AND THEY EXPERIENCED THEM GOING THROUGH IT AND PROBABLY THREE OR FOUR PEOPLE, I THINK WE'RE UP TO PROBABLY FIVE OR SIX, MAYBE WATCH US ON CHANNEL 10. SO THE PERSON THAT WANTS TO JOIN UP WITH LEADERSHIP CRAVING FOR THE NEXT CLASS, I WOULD HIGHLY RECOMMEND IT. AND, UH, YOU CAN SAY JUST WHAT KIND OF SPIRIT THAT AM. AND, UH, I'M, I'M QUITE SURE THAT THE BOARD WOULD PROBABLY GO ALONG WITH HELPING YOU W WE'RE HERE TO ASK FOR THE ORDER. WE UNDERSTAND IT'S TOO EARLY FOR YOU TO COMMIT TO, UH, UH, FUNDS THAT FAR AWAY. WHAT WOULD YOU SUGGEST OUR NEPS NEXT STEP? [00:10:01] THEY SHOULD, WE STAY IN CONTACT WITH MR. HARRISON? I LIKE, I, YOU KNOW, I THINK IT'S NOBLE FOR YOUR ORGANIZATION TO PURSUE THIS PROJECT, PARTICULARLY WHEN I LOOK AT THE MEMBERS AND I KNOW NONE OF YOU LIVE IN THE AREA, SO YOU WON'T PERSONALLY BENEFIT FROM THAT THIS PROJECT, BUT, UH, SOME FOLKS WILL MAINLY THE FOLKS WHO LIVE IN, IN THE AREA. AND, UH, UH, I'D JUST LIKE TO MOVE THAT WE ACCEPT THE PROJECT AS PROPOSED AND WE'LL WORK OUT THE LOGISTICS AT A LATER TIME. SECOND, ANY FURTHER DISCUSSION OF THAT? NOT A YES. JUST THE BOY. ALL IN FAVOR. SAY AYE. ALL OPPOSED. COULD WE POSSIBLY GET SOME FEEDBACK FROM THURMAN? I KNOW HE'S HE'S HE'S HERE. HE'S ANXIOUS. OKAY. WELL, WHAT WOULD BE, UH, HIS FEEDBACK AND FOR WE'LL BE HEADED MALE, WE'VE HELPED HELPING THE GROUP. I'M JUST TRYING TO KEEP A STRAIGHT FACE. REALLY. I'VE BEEN SMILING SINCE DAVID APPROACHED ME WITH THE IDEA OF BACK AT HOME, LIKE CHRISTMAS AND ALL THIS REALLY, BUT, UM, NOW BE AWARE, THIS MIGHT NOT TAKE AWAY 25,000 OUT OF YOUR BUDGET. WELL, LAST YEAR, $25,000 WHERE YOU'RE TOLD WHAT'S YOUR TOTAL BUDGET FOR FIVE PLAYGROUND EQUIPMENT. SO THAT'S TRUE. PLAY THE GAME COMING UP, RIGHT. AND THAT'S TRUE. AND WE'RE COMMITTED TO REPLACING PLAYGROUNDS THROUGHOUT THE CITY, NOT JUST OVER AT HENDERSON PARK, WE WERE DEVELOPING A REPLACEMENT PROGRAM FOR PLAYGROUNDS. THAT'S GOING TO TAKE ABOUT FIVE YEARS, FIVE TO SEVEN YEARS, REALLY TO DO IT RIGHT, UH, WITH ALL THE ADA REQUIREMENTS THAT WE FACE. ALL OUR PLAYGROUNDS AT THIS POINT IN TIME ARE NOT IN COMPLIANCE WITH ANY OF THE RULES, ANY OF THE REGULATIONS. SO WE KNOW WE'RE STARTING FROM, FROM BEHIND. UH, BUT THIS IS CERTAINLY A GREAT START. OUR FIRST PRIORITY IS TO, UM, TO RENOVATE THE PLAYGROUND AT FORT TOTTEN PARK. UH, WE'RE GOING TO CONTINUE, WE'RE GOING TO DO THAT. AND THIS YEAR'S BUDGET WAS THE IDEA THAT, UM, WHAT LEADERSHIP CRAVEN IS PROPOSING TO DO AT HENSON PARK THAT BUMPS THAT PLAYGROUND UP FROM WHAT WOULD HAVE BEEN NUMBER THREE TO NUMBER TWO NOW IN THE PRIORITY LIVES HERE WITH GLEN BURNIE PARK BEING NOW, NUMBER THREE. SO WE THINK WE CAN DO TWO AT THE SAME TIME, INSTEAD OF HAVING A WAY TO HEAR, UH, CITY MANAGER, WHAT WOULD ANY DISCUSSION OR ANY DIALOGUE NEEDS TO BE DONE NOW IN TERMS OF THEIR LIABILITY? NOT A LOT OF IS IN TERMS OF WHEN A PARTNERSHIP. UM, I DON'T THINK WE'D HAVE TO, I MEAN, NOT TONIGHT, BUT I MEAN, WE GO THROUGH, YOU ASK, WE'LL HAVE TO WORK OUT THE DETAILS, BUT I DON'T THINK THAT WOULD BE TOO COMPLICATED. OKAY. YEAH. I JUST WANTED TO GET THEM TO FIRST BASE AND THAT I CAN GET THEM HOME FROM HERE. THERMOS, TRYING TO TELL YOU TO GET USED TO THAT SMILE. IN FACT, THIS IS, WE SEE A LOT OF, YES, SIR. VERY MUCH IN FAVOR OF THAT. AND I'LL EVEN HELP SPREAD OUT THE WOODCHIPS YES. YOU ALL RIGHT. WELL, WE REALLY APPRECIATE THAT EFFORT. AND UH, IF YOU SEE ANY OTHER PROJECTS AROUND TOWN, WE CAN ALWAYS WORK OUT A SMALL DETAIL YOU CAN TALK ABOUT, AND THAT'S JUST, THAT'S REALLY GOOD. I TELL YOU IT'S, YOU KNOW, WHEN YOU SPEND THE TAXPAYER'S MONEY, AIRMAN AND MAN, AND YOU, AND YOU KNOW, YOU, YOU PROTECT HER, YOU DO IT GOOD. THAT MAKES YOU FEEL REAL GOOD, BUT WHEN YOU SPEND IT AND YOU KNOW, YOU DOING GOOD, THAT REALLY PUTS AN EXTRA LITTLE FOOTNOTE ON IT. SO JUST, I GUESS I'LL BE GRANTING ALONG WITH FARM. SO WE APPRECIATE THAT. ALL RIGHT. ANYBODY ELSE WANT TO SAY ANYTHING FROM LEADERSHIP CRAIG? OKAY. WE'LL MOVE ON THEN TO THE, UH, WE CAN SET OUR POINTING TO VOLUNTEER FIRE CHIEF AND THE VOLUNTEER ASSISTANT CHIEF AND THE NOMINEES ARE, LET'S SEE HERE. THE FIRE BOARD HAS UNANIMOUSLY RECOMMENDED THAT, UH, THE CHIEF BE KENNY WELLINGTON AND THE DEPUTY CHIEF BE PAUL MCCALLUM. AND, UH, HERE TONIGHT, I THINK I SEE, CAN YOU STAND THAT? SO ALL THE FOLKS CAN SEE WHAT YOU LOOK LIKE AND PAUL MCCALLUM AND, UH, ANYBODY WANT TO ASK HIM ANY QUESTIONS ON, WELL, NOW WE HAD ABOUT THAT MUCH IN THEIR RESUME. I LIKE [00:15:01] TO MAKE A MOTION THAT WE ACCEPT THE TWO PROPOSED CHIEF AND ASSISTANT CHIEF. NOW WE'RE WE APPRECIATE YOU, BOTH OF YOU GUYS. I KNOW YOU'LL DO A GREAT JOB AND, UH, YOU ALL THE WAY IS THAT ONE OF YOUR LITTLE FIREFIGHTERS THERE AND THEY SAY, I DON'T THINK I'LL LIVE TO SEE THE DAY THAT HE'LL BE OUT HERE, BUT I'M SURE HE'LL BE UP HERE. OKAY. WE'LL VOTE ON THIS. UM, I'VE BEEN . THAT'S WHY I KNOW HE'S BRINGING THAT LITTLE NOTCH IN HIS BAIL RIGHT NOW. I GO BACK A LONG WAY. WE APPRECIATE IT ALL THE FIREFIGHTERS AROUND NEIGHBORING, WHICH IS A LONG HISTORICAL GROUP. AND, UH, I'VE SAID IT MANY TIMES. IF YOU'RE GOING TO HAVE A FIRE, I JUST SEEM TO SEE THIS CROWD COMING TOWARD MY HOUSE AND ANYBODY IN THE COUNTRY. SO I APPRECIATE THE JOB. SO ANYBODY WANT TO MAKE A MOTION ON THE SECOND? YES. AND, UH, IS THIS A VOICEMAIL? I CAN'T VOTE AGAIN. ALL IN FAVOR. SAY AYE. ALL OPPOSED THE AYES HAVE IT. SO THERE YOU ARE. THE NEXT THING I HAVE IS THE CONSENT AGENDA. MOVE IT UP, SEND IT TO THEM. SECOND FURTHER DISCUSSION. IF NOT CALL ROAD, PLEASE. MA'AM YES, YES, YES. OKAY. MR. MATT, I DON'T HAVE ANYTHING FREE. NO, SIR. MR. RYAN UPON I HAVE AN APPOINTMENT, BUT UM, I HAVE A NOMINATION PROTOTYPE. I WANT TO HEAR FROM JAY FIRST. THIS IS REGARDING THE MAYOR PRO TEM. I'LL DO THAT MISCELLANEOUS. OKAY. THAT'S FINE. I'LL HAVE NO IT'S ALL RIGHT. MISCELLANEOUS MR. MADDEN. YES, SIR. I HAVE, UH, MR. MAYOR AND MEMBERS OF THE BOARD. I WANT TO THANK YOU FOR THE HONOR OF SERVING AS MAYOR PRO TEM FOR THE YEAR 2000. YOU SEE, I GOT YOU THROUGH THE MILLENNIUM WITHOUT ANY MAJOR PROBLEMS. ANYWAY, AND AS I A TRADITION HAS IT, WE ROTATE THE, UH, POSITION OF MAYOR PRO TEM. AND I'D LIKE TO PASS THE, UH, HONOR TO THE SENIOR MEMBER. I'M A JUNIOR MEMBER OF THE BOARD. I'D LIKE TO PASS THE HONOR TO THE SENIOR MEMBER IN TERMS OF SERVICE ON THE BOARD OF ALDERMAN TO MAKE THE NOMINATION FOR THE MAYOR PRO TEM 2001. THANK YOU, MR. MADELINE, ARE YOU SAYING IT THE SCENE? YOU REMEMBER AS MR. RAINER? OKAY. PARADOX. I'M THE YOUNGEST. OKAY. WELL, WE HAVE DIVIDED ACTUALLY, I SHOULDN'T BE TIM NOW, BUT I DON'T THINK I CAN FULFILL THE OBLIGATION WITH MY SCHEDULE. SO I LIKE TO NOMINATE JULIUS PAUL HAM TO BE MAYOR PRO TEM FOR THE 2000 2001 OR NOT FISCAL YEAR, BUT YEAR, SECOND, MOST. AND THE SECOND, AND I GUESS, IS THIS A VOICE, BUT ALL IN FAVOR, SAY AYE. AYE. ALL OPPOSED. NO, DUDE, JUST YOU'RE THE MAN. AND I WANT TO THANK MR. MADDEN FOR DOING AN OUTSTANDING JOB. HE NEVER LET ME DOWN. I APPRECIATE THAT. IT WAS A GOOD EXPERIENCE. AND IN FACT, HE WAS LAUGHING AT A COUPLE OF HOT POTATOES UNINTENTIONALLY. IT WAS FINE. LAST THING. WAS THAT AN INTERVIEW MISCELLANEOUS? YES, SIR. MR. FREEZE, NOTHING FOR ME, MR. RICE. NO, SIR. NO, SIR. ONE MORE THING. UH, SINCE I'M PASSED ON THAT, I LIKE TO WISH EVERYONE, A HAPPY HOLIDAY SEASON AND A PROSPEROUS AND WEALTHY AND HEALTHY YEAR, 2001 FOR EVERYONE. THAT'S ALL. THANK YOU. OKAY. YEAH. I HAVE SEVERAL ITEMS. DO YOU WANT ME TO BRING THEM UP ON A MISCELLANEOUS, UH, ON THE, THE ATTORNEY FOR, UM, WELL, YOU KNOW WHAT, A STRAIGHT OFFICIAL MEANING THAT MEANS YOU CAN BRING THEM UP ANY TIME YOU WON'T LEAVE IT IN THE MIDDLE OF WHATEVER I'M SAYING. SAY GO RIGHT AHEAD. FIRST ITEM. I'VE GOT A LIST OF PROPERTIES WHICH ARE PROPOSED TO BE DONATED TO THE CITY FOR ONE REASON OR ANOTHER, THAT HAS NOT BEEN ACCOMPLISHED BEFORE THIS MEETING. SEVERAL OF THEM AS A PROBLEM. AS FAR AS THE DESCRIPTION IS CONCERNED, THERE ARE SEVERAL OTHERS WITH THE DEEDS HAVE BEEN DRAWN. THEY JUST HAVEN'T BEEN SIGNED. I WOULD LIKE TO GET THE BOARD'S APPROVAL TO ACCEPT THE SUBJECT TO APPROVAL [00:20:01] TO THE CITY MANAGER AND THE CITY ATTORNEY. IF I CAN GET IT WORKED OUT BETWEEN NOW AND FIRST YEAR, MOST OF THESE PEOPLE, THE FIRST ITEM IS LEE MORGAN PARK. THAT'S NOT A DONATION, STRICTLY CHANGE. THEY'VE GIVEN THIS TO US. I MOVE, WE ACCEPT THESE PROPOSED GIFTS. AFTER EVERYBODY'S REASONING, WE SHOULD ACCEPT HIS REQUEST THAT THEY EVER DO THEM WELL SUBJECT TO, UH, THE REVIEW OF THE DESCRIPTION AND THE CONVEYANCES OR BY THE CITY MANAGER AND THE CITY ATTORNEY. OKAY. PROSPECT IT, THEY, UH, THE SECOND ONE ON THERE, IS THAT AN EITHER OR, OR IS THERE SOME CONFUSION ABOUT THE EXACT ADDRESS OF WHAT THERE IS ONE HOUSE AND IN PROCURING THIS OTHER INFORMATION THIS AFTERNOON, I NOTICED THAT THERE WERE TWO STREET ADDRESSES ON THE DEED, WHICH RESULTED IN MARY LIVING, WHY TO GET INTO THE PROPERTY. AND SO I TOLD SANDY, JUST PUT AN ORDER IN THE END UNTIL I COULD MAKE THAT DETERMINATION. OKAY. THEY'RE NOT GIVING BOTH OF THEM. I MAY HAVE GIVEN ONE OF THEM AND I THINK THEY JUST OWN ONE. OKAY. WE'VE HAD A MOTION AND THE SECOND, JUST THE BOYS BOTH. OKAY. LET ME ASK YOU A QUESTION, ALAN. MOST OF THESE ARE THESE, UH, PROPERTIES OF THEIR HOMES, AUTOMOBILES. UH, SOME OF THEM HAVE RESIDENCES ON THEM. SOME OF THEM DON'T, BUT ARE GENERALLY PROPERTY THAT PEOPLE HAVE GIVEN UP BECAUSE THEY JUST DON'T WANT TO HAVE TO MAINTAIN THEM WITH THE, UH, EXPENSIVE, UH, KEEPING THEM UP SO THAT THEY'RE JUST TURNING THEM OVER TO US. SO WE DON'T HAVE TO FORECLOSE ON THEM. AND THEN THEY GET A, UH, WELL, FOR EXAMPLE, CHARRO DANIEL'S PROPERTY, THAT THAT'S A PIECE OF PROPERTY ON ROUND THREE STREET THAT AT ONE TIME BELONG TO MY AUNT, MARY WARD. AND SHE CONVEYED ALL OF THE PROPERTY THAT SHE OWNED. SOME OF IT ON ROUND THREE, SOME OF IT ON THE ALLEY, WHICH WE BACKED UP TO IT. AND THE TIME, UH, I THINK IT WAS YANNI CAME IN WITH THE INFLAMMATION ON THIS AND WE LOOKED AT IT AND IT LOOKS LIKE THIS MAY HAVE BEEN CONVEYED BY A DEED DRAWN BY ANOTHER FIRM IN TOWN. UH, I GOT EARL DANIELS UP THERE AND CINDY SAT DOWN WITH HIM AND TRIED TO LOCATE THE PROPERTY WITH A SKETCH. HE COULDN'T LOOK, WE MAY NOT BE ABLE TO. OKAY. ALL RIGHT. SO THAT'S WHY, THAT'S THE REASON THAT'S NOT INVOLVED. THERE'S SALLY WILSHER HAS BEEN HERS DAUGHTER A COUPLE OF YEARS AGO. SHE WANTED TO DONATE THIS PROPERTY AND I COULDN'T FIND ANY RECORD OF IT THAT HADN'T BEEN CONVEYED TO BEN AND SHE GOT IT UNDER HIS WILL. SO UNTIL WE CAN GET THAT TWO OR THREE, LIKE THAT WE'LL NEED TO GET THE CORRECT DESCRIPTION, OR WE PUT IT ON RECORD AND ACCEPTED. MR. WARDEN DOES THE SIZE OF THESE PROPERTIES OR ANY OF THEM LEND THEMSELVES TO A, DO THEY MEET THE SIZE REQUIREMENTS FOR THE ZONING SO THAT PERHAPS WE MIGHT BE ABLE TO DEAL WITH HABITAT FOR HUMANITY AND GET SOME HOUSES BUILT? I THINK THIS ONE THAT BELONGS TO THE HUMAN IS FOR EXAMPLE, IT'S PROBABLY TWENTY-FIVE FEET WIDE. I, IF I COULD, I'D HAD SOMETHING CAUSE THEY HADN'T MISSED WARD. THIS IS CORRECT. MOST OF THEM ARE NOT OF ANY VALUE, BUT THERE ARE A COUPLE OF BLOCKS THAT ARE POSSIBLE. AND A COUPLE OF THOSE DWELLINGS THAT ARE ON THE PROPERTIES, OUR HOSPITAL ALSO, MIKE AND I TALKED ABOUT THOSE AND ONCE WE GET THE PROP IN OUR HANDS, WE MAY BE LOOKING AT POSSIBLY DOING SOMETHING WITH HABITAT IN A COUPLE OF EVENTS. WELL, MY NEXT QUESTION, I OWN THE PROPERTIES THAT ARE NOT BIG ENOUGH TO BUILD A HOUSE ON. WOULD IT BE REASONABLE TO OFFER THESE FOR SALE? PERHAPS THE ADJOINING LAND OWNER MIGHT WANT TO BUY THEM. AT LEAST, UH, WE HAVE NO REASON TO OWN LITTLE PEEP, LITTLE SCATTERED PIECES OF PROPERTY AND IT WOULD AT LEAST PUT IT BACK ON THE TAX ROLLS. SOMEBODY CAN GET SOME USE OUT OF IT, MAYBE, BUT NOT NOW. WHAT DO WE GET THAT COULD BE DONE, BUT IT WOULD HAVE TO BE DONE IN CONFORMITY WITH ALL I KNEW WE COULDN'T JUST ALL HIM. RIGHT. BUT THEY WOULD PROBABLY BE THE ONLY ONES INTERESTED IN IT. THEY'LL HAVE SOMEONE APPROACH TO SELL THOSE PROPERTIES. AND WE CERTAINLY WOULD BE WILLING TO GO THROUGH THE PROCESS. MERCI, THERE'S A COLUMN HERE THAT REFLECTS THE TAX VALUE AND MOST OF THEM HAVE SOME SUBSTANTIAL PHASE. OKAY. THE SECOND, JUST A BOYS' VALUE ALL IN FAVOR OF MAKING THE MOTION JUST FOR YOU TO PROCEED ON THAT. RIGHT. [00:25:01] ALL IN FAVOR, SAY AYE. ALL OPPOSED. ALL RIGHT, MR. WARD. NO, SIR. I HAVE ONE MORE. AS YOU KNOW, THE CITY IS ABOUT TO CONDEMN. I HAVE TWO MORE. HE SAID HE IS ABOUT TO CONDEMN THE ROY GAME PROPERTY. A SUBSTANTIAL PORTION OF WHICH IS ON THE FLORENCE MERGE LANE. AND I HAVE PREPARED A NOTICE, WHICH IS TO BE SENT OUT TO MR AND MS. GAME COMPLY WITH THE STATUTE REQUIRES THAT ANY KIND OF NORMAL GIVE 30 DAYS NOTICE OF CONDEMNATION. AND I AM NOT AWARE OF ANYTHING THAT REQUIRES IT, BUT I'M NOT COMFORTABLE JUST TAKING IT ON MYSELF. I HAVEN'T BEEN TOLD VERBALLY, GO AHEAD WITH THE KIND OF NATIONS. SO I HAD A RESOLUTION WHICH WOULD AUTHORIZE THE MAYOR AND THE CLERK TO SEND OUT THIS NOTICE. AND I WOULD ASK THAT YOU AND WE MADE ALL THE, TO TRY TO TARGET THIS AGAIN. YES, I, IN FACT, I WROTE HIM A LETTER AND TOLD HIM, WE'D PAY HIM THE $184,000, WHICH IS REFLECTED IN THIS NOTICE. AND I HAVEN'T HEARD THE FIRST WORD FROM HIM. UM, I AM TOLD THAT HE HAS A BROTHER WHO LIVES UP IN THE NORFOLK AREA, VERY SUCCESSFUL IN HANDLING A CONDEMNATION AGAINST HIMSELF. WHEN MR GAME HAS ASKED HIS BROTHER TO HANDLE THIS, AND HE HAS HIS LAWYER TO COME DOWN HERE TO REPRESENT HIM. HAVE YOU HEARD ANYTHING FROM ANY OF THEM? NO. DO YOU HAVE ANY REX'S MR. GAME BRANSON. AND I'VE HAD SOME CONVERSATION WITH JIM AND JIMMY INDICATED TO MEET THEM AS A LAWYER IN SUMMER SOUTHERN FARM. AND JIMMY INDICATED THAT HE WAS VERY GRATEFUL THAT HIS GRANDFATHER HAVING DECIDED TO GET SOMEONE ELSE TO HANDLE IT. IN OTHER WORDS, HE DIDN'T WANT TO BE INVOLVED IN THE FAMILY SITUATION. IT IS 12 AND THREE CORE ACRES IS ACTUALLY FOUND A WARRANT FOR THE CAR. AND THIS 3.09 ACRES, WHICH IS A HUNDRED FOOT DEEP STRIP ALONG BESIDE THE FARM, WHICH IS THAT LAND THAT'S CORRECT. IT'S NOT IN HIS THEN LEAVE MOBILE HOME PARK. THIS IS ALL A PROFIT, WHICH IS OUTSIDE OF THAT MAX FREEZE DISTANCE. I BELIEVE IT'S ALSO SUPPOSED TO THAT FOOTAGE THAT WE'VE GOT MARRIED. IT'S PART OF THE REQUIREMENT FOR OPERATIONS. UM, WELL THE STATE, WE CAN'T GET A PERMIT TO OPERATE THE FACILITY UNTIL WE OWN THE PROPERTY. THAT'S I GUESS REALLY SAID THAT FOR THE PEOPLE PRESENT, THIS IS THE ONLY PARCEL THAT WE DID NOT. AND WHAT DON'T WE NEED ON THIS VOICE? MOST OF THE RESOLUTION, WHICH IS COMING OUT THE RESOLUTION SECOND. ALL RIGHT. ANY FURTHER DISCUSSION? NOT CALLED A ROAD PLEASE. MA'AM YES, YES, YES, YES. ANYTHING ELSE? ONE MORE ITEMS TO MAYOR IN CONNECTION WITH THE DONATION OF PROMPT IS ALBERT BELL. AND THEN HIS WIFE, JOYCE HAD TALKED ABOUT CONVEYING A PIECE OF PROPERTY TO THE CITY LOCATED ON . IT WAS A CONVENIENCE STORE AND A STARFISH SHELL STATION. THEY SOLD BP PETROLEUM PRODUCTS. GASOLINE. I GOT A CALL FROM DANNY SOME WEEKS AGO ABOUT WHETHER SYDNEY COULD ASSIST ALVIN AND REMOVING THREE UNDERGROUND TANKS THAT WERE LOCATED ON THE PROPERTY. I HAD A CONTRACT BY WHICH, UH, MR. BOWS AND INDEMNIFY THE CITY AGAINST ANY LAWS AND BY VIRTUE OF DOING THAT AND HE THOUGHT IT WAS APPROPRIATE. THAT CITY GO AHEAD AND REMOVE THE PAINT AND VIEW OF THE FACT THAT HE'S GIVEN THE PROPERTY TO THE CITY. AND THIS IS THE AGREEMENT THAT, UH, TO DO THAT PARTIALLY IS WRONG. AND IT GOT COVERED UP ON MY DESK. I GOT IT DONE LAST WEEK. WHY IS IT THE COMPARISON, DANNY, BETWEEN THE COST OF REMOVING THOSE TIMES AND WHAT IT'S GOING TO BE WORTH TO IT AND WHAT WE GOING TO USE IT BEFORE? I'M SURE THIS HAS BEEN DISCUSSED. OKAY. IT'S PROBABLY WORTH MORE THAN THE COST OF REMOVAL. [00:30:01] UH, WE CAN DO WITH OUR FORCES. UH, THEN WE'LL BE REQUIREMENT TO HAVE SOME ENVIRONMENTAL ASSESSMENTS MADE. BUT OUTSIDE OF THAT, NO REAL COST. DOESN'T INCLUDE ALL THAT IN HOUSE. AND IT HAS A BUILDING ON THE PROPERTY AT PRESENT TIME. WE ARE, WE ARE, WE'RE USING IT NOW FOR A STORAGE PURPOSES. THIS CAME UP ABOUT A YEAR AGO. I ALMOST TALK WHEN IT FIRST CAME UP, WE'D ALREADY DONE. YEAH, IT'S BEEN, HE IS DELIGHTED AT SEVERAL TIMES FOR ONE PURPOSE OR ANOTHER, BUT I THINK IT'S ABOUT TO FINISH UP. THEY CONTACTED ME PROBABLY TWO YEARS AGO ABOUT DOING THE SAME THING. NEXT THING I HEARD AND HE WANTED TO WAIT TILL THE END OF THE YEAR. NEXT THING I ALREADY HAD SOMEONE THAT WANTED TO BUY IT FROM HIM. HE INDICATED WHILE HE WAS STILL GOING TO GIVE IT TO THE CITY, BUT, UH, WE MIGHT WANT TO SELL IT FOR THIS INDIVIDUAL AND THEN IT DIDN'T GET DONE. IT DIDN'T GET DONE. AND I PREPARED A DEED FROM HIS FAMILY PARTNERSHIP TO THE CITY, UH, SOME MONTHS AGO, PROBABLY BACK IN THE MIDDLE OF THE YEAR. AND HIS LAWYER CALLED ME SEVERAL WEEKS AGO AND SAID THAT IT NEEDED TO BE FROM HIM AND HIS WIFE INDIVIDUALLY. IT WAS A PARTNERSHIP AND BUY THE PROPERTY BACK TO ALVIN JOYCE. SO I PREPARED A NEW DEED, WHICH I THOUGHT HAD BEEN SENT OUT THERE. WE'LL SEND YOU THOUGHT IT HAD BEEN SET OUT BADLY PITTMAN HIS LAWYER CALL, UH, MAYBE A WEEK AGO, 10 DAYS AGO AND SAID, NO, SHE HADN'T RECEIVED. THAT SHOULD HAVE BEEN ON THIS LIST OF PROPERTIES, WHICH I HANDED OUT EARLIER. I SEE THAT. IT'S NOT THAT I SEE WHAT THE VALUE OF THE PROPERTY WAS. WHY HAVE YOU GOT DRESSED UP RESOLUTION PROPOSAL OR THIS IS A JUST RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT. IT WAS THEN DILLMAN VACATION AGREEMENT, UH, PREPARE. YEAH, HOPEFULLY NO. AND HE'S INDEMNIFY US FOR ANY EXPENSE IN CONNECTION WITH THE REMOVAL OTHER TIMES THAT WHAT IT SAYS, WELL, SHE HAD THE CITY AND CURRENT LIABILITY BY VIRTUE OF REMOVING THE TANKS AND HE WOULD IDENTIFY THE CITY AGAINST ANY LOSS. I DON'T SEE THAT THERE IS ANY, UNLESS SOMEBODY WENT OUT THERE AND ROB THEM MATCH DOWN AND PULL THEM UP. NO, WHAT WE'LL COVERING OURSELVES FROM AN ENVIRONMENTAL STANDPOINT. WHAT'D YOU GOTTA TURN IT RIGHT TIME. MIND TO ASK HIM, SO WHAT ARE YOU DOING? HE SAID, I'M LOOKING FOR A LOOPHOLE. YOU KNOW WHAT I W I WISH IT WAS A LITTLE STRONGER SAYING THAT, YOU KNOW, THE PARTIES, THE SECOND PART, MR. AND MRS. BELLA SPECIFICALLY AGREED TO INDEMNIFY AND HOLD, SEE THE HOMELESS FROM ANY LIABILITY WHICH YOU MADE FOR THE ABOVE SERVICES. I BROAD EXPENSES THAT WOULD INCLUDE EXPENSES IN CONNECTION WITH THEM. THE ONLY REASON THAT I, UH, I'M JUST CONCERNED ABOUT, UH, SINCE THERE WAS NO ENVIRONMENTAL ASSESSMENT DURING THE PROPERTY, YOU DON'T HAVE SUBSETS. HE'S BEEN OPERATING THE GASOLINE STATION FOR A SIGNIFICANT PERIOD OF TIME. HE MAY HAVE CONTAMINATED, NOT ONLY THAT PROPERTY, BUT ADJOINING LAND. AND WE MIGHT HAVE TO BEAR THE EXPENSE OF CLEANING UP, CLEANING IT UP. BUT IF YOU SAY IT COVERS COVERS THAT, THEN I KIND OF DO I UNDERSTAND, PLUS HE GETS A WRITE OFF FOR THE END OF THE YEAR. I MOVE ADOPTED RESOLUTION. ANY FURTHER DISCUSSION, IF NOT, AT LEAST ON THE ROAD. YES, YES, YES, YES, YES. ALRIGHT. ANYTHING ELSE HERE? THAT'S ALL I WAS THINKING THERE. THEN DID SHAVE AND ASSESSMENT CHANGE, RESUME PLAN, CITY MANAGER. DO YOU HEAR ANYTHING ABOUT THE REPORT? THE LAST THING WE HAVE IS ITEM 13 AND THAT LOOKED LIKE SALES, A JOURNEY * This transcript was created by voice-to-text technology.
