THE MAXIMUM, UM, FLOW FOR ANY ONE GIVEN DAY WAS 4.6 MILLION GALLONS PER DAY.
AND WE ALSO RECORDED 2.3, THREE INCHES OF RAIN AT THE PLANT, THE PLANT, UH, FAILED TOXICITY IN THE MONTH OF FEBRUARY, THEY ALSO FAILED TO, UH, MEET THE EFFICIENCY REMOVAL FOR TOTAL SUSPENDED SOLIDS.
UM, THEIR RATE, UH, THAT PARTICULAR MONTH WAS 82%.
UM, THEY DID MEET, UH, ALL THE OTHER PARAMETERS OF THE MPDS PERMIT.
UM, GIVE YOU AN UPDATE ON, UH, SEVERAL OTHER ITEMS. THE WASTEWATER TREATMENT PLANT, UM, PERMITTING PROCESS HAS MOVED ALONG RATHER QUICKLY IN THE LAST, UM, 10 DAYS.
UH, WE ARE WITHIN A WEEK TO 10 DAYS OF RECEIVING AN AUTHORIZATION TO CONSTRUCT THE WASTEWATER TREATMENT PLANT.
THE PLANS AND SPECIFICATIONS WILL BE DELIVERED, UM, TO RALEIGH, UH, ON THURSDAY.
AND THEY HAVE TO DO A SHORT REVIEW TO MAKE SURE THE LAST ITEMS THAT WERE OUTLINED THAT NEEDED TO BE CHANGED OR CHANGED.
AND WE WILL BE READY TO GO TO BID AS SOON AS WE GET AN AUTHORIZATION TO CONSTRUCT ON THAT.
UM, THE SECOND, UH, ORDER OF BUSINESS IS THE, UM, WATER RECLAMATION PROJECT, UH, UTILIZING THE OLD MARTIN MARIETTA QUARRY PROJECT.
UH, IF YOU'VE BEEN BY THERE IN THE LAST COUPLE OF DAYS, UH, THEY HAVE STARTED REMOVING SOME FENCING AND, UH, THEY WILL BE TAKING DOWN THAT, UM, TREE LINE RIGHT THERE ON GLEN BURNIE, ADJACENT TO THE PROPERTY.
AND, UM, WE HAVE AWARDED A CONTRACT TO, UM, W O WHITE, UH, TO DIG THE CANAL FROM THE EXISTING BARGE CANAL AROUND TO THE VERY LOW POINT THERE ON, UH, GLEN BURNIE ROAD.
UM, THEY SHOULD BEGIN CONSTRUCTION BEGAN DIGGING IN THE, UM, PROBABLY IN THE NEXT WEEK, ONCE THAT, UH, CLEARING HAS TAKEN PLACE.
UM, WE ALSO IN PERMITTING, UM, THE PROJECT, UM, DAM SAFETY IS GOT ABOUT TWO WEEKS BEFORE THEY WILL GIVE THEIR BLESSINGS TO OUR DESIGN OF THE, UH, AUTOMATIC OVERFLOW DEVICE IN CASE THE, UH, QUARRY LEVEL WERE TO RISE.
THEY WANT AN AUTOMATIC DISCHARGE TO THE RIVER, UM, TO PROTECT THE DYKES, UM, THAT HAS BEEN SUBMITTED TO THEM.
AND THEY'RE TELLING US THAT IT WOULD BE ABOUT, UH, TWO WEEKS FROM NOW THAT THEY WILL, UH, ISSUE THEIR BLESSING ON THAT.

THE STATE IS LOOKING FOR IS A REPORT FROM OUR CONSULTANTS THAT WILL TELL THEM WHAT EFFECT THE QUARRY IS GOING TO HAVE ON THE GROUND WATER IN THE IMMEDIATE AREA, AROUND THE QUARRY.AND, UH, WE'VE GOTTEN SOME GOOD DATA VERY RECENTLY DUE TO THE, UH, RAINFALL THAT WE'VE HAD, THE QUARRY LEVEL'S RISEN ABOUT A FOOT, AND NOW WE CAN SET A SECOND SET OF DATA POINTS AND THEY'LL BE ABLE TO, UH, GIVE SOME DEFINITIVE ANSWERS AS TO WHAT'S GOING TO HAPPEN IN THE FUTURE.
SO I WOULD EXPECT THAT TO, TO PROCEED, UM, PROBABLY, UH, TAKE US ABOUT ANOTHER MONTH TO GATHER ENOUGH DATA TO DRAW ANY CONCLUSIONS.
THEN THE LAST THING THAT I WOULD LIKE TO TALK TO YOU ABOUT TONIGHT, UM, IS A COUPLE OF LETTERS.
UH, ACTUALLY ONE LETTER THAT I RECEIVED THIS WEEK, UM, WE RECEIVED A, UM, ENFORCEMENT ACTION FROM THE STATE, UH, BECAUSE OF OUR FAILURES OF TOXICITY FOR EIGHT OF THE LAST 12 MONTHS.
THEY HAVE, UM, ASSESSED A CIVIL PENALTY AGAINST US OF, UH, $6,000 AND, UH, $47, UH, FOR ADMINISTRATIVE FEES.
AND THEY ALSO ISSUED US A LETTER ASKING US TO ENTER INTO A SPECIAL ORDER OF CONSENT.
AND THE SPECIAL ORDER OF CONSENT BASICALLY ALLOWS US TO, UM, VIOLATE NPDS, UM, UH, GUIDELINES THAT WE HAVE IN PLACE NOW AND ENTER INTO A NEW MPDS PERMIT THAT DOES AWAY WITH TOXICITY.
IT DOES AWAY WITH SOLIDS REMOVAL.
UM, UH, IT PUTS OUR BOD, UH, LIMIT, UH, AT 60 MILLIGRAMS PER LITER OR PARTS PER MILLION, UM, WHICH IS, UH, TWICE WHAT WE'RE ALLOWED NOW.
AND THAT'S BECAUSE WE'LL BE DOING AWAY WITH HALF OF THE WASTEWATER TREATMENT PLANT FOR THE NEXT, ROUGHLY TWO YEARS WHILE WE CONSTRUCT OUR NEW PLANT.
AND, UM, WHAT I'D LIKE TO DO TONIGHT IS ASKED THAT, UM, ONE OF YOUR BOARD MEMBERS MAKE A MOTION TO ALLOW THE MAYOR TO SIGN THE SPECIAL ORDER OF CONSENT.
UH, WE HAD SOME PROBLEMS WITH IT.
THEY, THEY OFFERED THIS TO US BACK ON FEBRUARY SIX.
AND ONE OF THE MAJOR PROBLEMS THAT I HAD WITH IT IS THAT WE DIDN'T HAVE ANY IDEA OF WHEN AUTHORIZATION TO CONSTRUCT WAS GOING TO TAKE PLACE WHEN WE WOULD GET THAT PERMIT TO BEGIN THE BUILDING PROCESS.
AND THEY TOLD US THAT WE HAD TO START THE PLANT BY JULY ONE AND BE FINISHED BY APRIL 15TH, 2003 SUBSTANTIALLY COMPLETE AND IN NEGOTIATIONS.
AND BECAUSE OF THIS AUTHORIZATION TO CONSTRUCT IS, IS COMING UPON US RATHER QUICKLY.
NOW I FEEL COMFORTABLE THAT WE CAN BEGIN CONSTRUCTION BY SEPTEMBER 1ST OF THIS YEAR AND BE COMPLETE.
UM, IT WOULD BE THREE MONTHS FROM APRIL, WHICH WOULD BE, UH, AUGUST 1ST, 2003.
WE'D NEED TO BE SUBSTANTIALLY COMPLETE.
AND, UM, THERE'LL BE SOME MORE DETAILS ON THAT.
UH, YOU'LL GET A CHANCE TO READ THIS, UH, SPECIAL ORDER OF CONSENT.
BE GLAD TO PROVIDE THAT TO YOU BEFORE WE ACTUALLY SIGN IT AND SEND IT TO THE STATE.
BUT I LIKE TO HAVE AUTHORIZATION FOR THE MAYOR TO SIGN THE SPECIAL ORDER CONSENT.

AND SO WHAT THEY'RE TRYING TO DO IS FIX AWAY SO THAT WE CAN, UH, GET OUT OF THE, UH, THINGS THAT WE CAN'T COMPLY WITH DURING THIS CONSTRUCTION TIME, UNTIL WE GET THE NEW PLANT IN OPERATION, THAT'S PART OF THE PROJECT.
WELL, WE DON'T HAVE TO PAY THAT $6,000.
WELL, I'VE WHAT I'VE ASKED IS, UM, THERE WAS A $2,000, 2050 $4 CIVIL PENALTY THAT WAS ASSESSED FOR FLOW BACK IN AUGUST AND SEPTEMBER.
I APPEALED THAT TO THE DIRECTOR OF DIVISION OF WATER QUALITY AND HE REVIEWED IT AND WOULD NOT, UM, RESEND THOSE FINES.
AND IN PART OF THE SOC IS THAT WE, WE HAVE THE OPPORTUNITY TO NEGOTIATE THOSE FEES.
AND AS AN UPFRONT PAYMENT, AS WE ENTER INTO THE SOC, WE WOULD SEND THEM A PAYMENT FOR THESE FINES.
AND WHAT I'VE ASKED THEM TO DO IS REDUCE THEM BECAUSE NUMBER ONE, THE FLOW, WE DIDN'T PUT ANY MORE NUTRIENTS THAN

WE WOULD IF WE WERE, IF WE WERE AT CAPACITY, I REALLY DON'T UNDERSTAND WHY HE MADE THE RULE.UH, I KNOW THAT THEY KNOW THAT I ASKED FOR THIS SOC FOR THE TOXICITY SEVERAL MONTHS AGO.

AND, UM, BECAUSE I'VE WAITED, THEY VIEWED THAT AS WE'RE TYING PEOPLE ON EVERY DAY, JUST TO KEEP FROM HAVING TO KEEP THAT ALLOCATION COUNT, AND THAT'S NOT BEEN THE CASE AT ALL, IT'S BEEN, I'VE BEEN TRYING TO GET THIS AUTHORIZATION TO CONSTRUCT FINALIZED NOW THAT I HAVE IT, I'M, I'M READY TO SIGN THE SOC, BUT, UH, THEY'VE THROWN A BUNCH OF CIVIL PENALTIES AND PRETTY MUCH STRONG ARMED ME AND THE CITY.
IN MY OPINION, ON THIS ISSUE, I HAVE A CON I HAVE A PROBLEM WITH A GOVERNMENT AGENCY, UH, FINDING A CITY, UH, I DON'T KNOW WHETHER IT WAS $6,000 IS A MAJOR PENALTY OR NOT, BUT I HAVE A GREAT DEAL OF DIFFICULTY UNDERSTANDING HOW THEY CAN GET AWAY WITH FINDING THE CITY WHEN WE'RE TRYING TO DO THE BEST THING WE CAN COMPLY WITH ALL THE REQUIREMENTS.
THAT'S NOT REALLY A MAJOR PENALTY.
WELL, IT'S STILL TO ME, $6,000.
I UNDERSTAND THAT THEY CAN'T FIND YOU 10,000 A DAY.

SO, YOU KNOW, IT WAS IN YOU'RE EXACTLY RIGHT.
IT DOESN'T, IT DOESN'T SOUND EXACTLY RIGHT, BUT, BUT IN THE BEST INTEREST OF THE CITY, I FEEL LIKE THEY, WHAT DAVID DID WAS, WAS THE RIGHT THING, BECAUSE RUSTY HAD BEEN BOUND UP UNDER, UNDER A CONTRACT.
IT MIGHT NOT HAVE BEEN LIVABLE, YOU KNOW, THAT WOULDN'T HAVE BEEN, BUT I THINK THEY ARE TRYING TO BE CONSISTENT.
THEY FIND OTHER CITIES ALONG THE WAY THAT I HAD VIOLATIONS OF THEIR PERMITS.
AND, YOU KNOW, IT, TOXICITY VIOLATION IS A VERY MINOR REALLY VIOLATION, BUT, UH, THEIR POLICY HAS BEEN TO GET TOUGH AND, YOU KNOW, THEY'RE GETTING TOUGH WITH EVERYONE.
AND SO I GUESS WE JUST FIT INTO THAT BALLPARK.
